L'employeur a soulev\u00e9 trois objections : (1) l'unit\u00e9 faisant l'objet de la demande n'\u00e9tait pas habile \u00e0 n\u00e9gocier collectivement parce qu'elle combinait l'\u00e9quipe interne et les employ\u00e9s occasionnels ; (2) la section locale a pr\u00e9sent\u00e9 la demande alors que l'effectif n'\u00e9tait pas repr\u00e9sentatif de la main-d'oeuvre normale parce qu'il avait \u00e9t\u00e9 gonfl\u00e9 par les employ\u00e9s occasionnels \u00e0 la date de la demande ; (3) la Commission devrait exercer son pouvoir discr\u00e9tionnaire de refuser le droit de vote aux employ\u00e9s occasionnels employ\u00e9s \u00e0 la date de la demande parce qu'ils n'\u00e9taient pas repr\u00e9sentatifs de la main-d'oeuvre de base.  La Commission a conclu que l'unit\u00e9 faisant l'objet de la demande \u00e9tait appropri\u00e9e pour la n\u00e9gociation.  Il est g\u00e9n\u00e9ralement appropri\u00e9 que les \u00e9quipes internes et les employ\u00e9s occasionnels soient couverts par une seule convention collective.  Le groupe d'employ\u00e9s n'\u00e9tait pas manifestement non repr\u00e9sentatif du groupe qui serait finalement repr\u00e9sent\u00e9 par la section locale.
