La section locale avait d\u00e9j\u00e0 \u00e9t\u00e9 jug\u00e9e comme \u00e9tant un syndicat au sens de la Loi.  Pas moins de quarante pour cent des personnes faisant partie de l'unit\u00e9 de n\u00e9gociation \u00e9taient membres au moment de la demande.  Le Ballet a contest\u00e9 l'estimation faite par la section locale du nombre d'employ\u00e9s dans l'unit\u00e9 de n\u00e9gociation propos\u00e9e et a propos\u00e9 une n\u00e9gociation diff\u00e9rente, soutenant que celle de la section locale ne pouvait \u00eatre appropri\u00e9e.  La Commission a conclu que l'unit\u00e9 de n\u00e9gociation propos\u00e9e par la section locale pouvait \u00eatre appropri\u00e9e et que la diff\u00e9rence num\u00e9rique entre les parties n'\u00e9tait pas importante. Elle a ordonn\u00e9 la tenue d'un scrutin de repr\u00e9sentation aupr\u00e8s de \"tous les employ\u00e9s du Ballet national du Canada travaillant \u00e0 la peinture et \u00e0 la finition de d\u00e9cors et d'accessoires de th\u00e9\u00e2tre dans la ville de Toronto, \u00e0 l'exception du directeur de production et des personnes de rang sup\u00e9rieur\".
