La section locale avait d\u00e9j\u00e0 \u00e9t\u00e9 jug\u00e9e comme \u00e9tant un syndicat au sens de la Loi.  Pas moins de quarante pour cent des personnes faisant partie de l'unit\u00e9 de n\u00e9gociation propos\u00e9e \u00e9taient membres de la section locale au moment de la demande.  L'employeur a contest\u00e9 l'estimation du nombre d'employ\u00e9s dans l'unit\u00e9 de n\u00e9gociation propos\u00e9e faite par la section locale et a propos\u00e9 une autre description, soutenant que celle propos\u00e9e par la section locale ne pouvait \u00eatre appropri\u00e9e.  La Commission a conclu que l'unit\u00e9 de n\u00e9gociation propos\u00e9e pouvait \u00eatre appropri\u00e9e et que la diff\u00e9rence num\u00e9rique entre les parties n'\u00e9tait pas importante. Elle a ordonn\u00e9 la tenue d'un scrutin de repr\u00e9sentation aupr\u00e8s de \"tous les employ\u00e9s de l'avant-sc\u00e8ne et des services d'alimentation et de boisson de la partie d\u00e9fenderesse dans la ville de Toronto, \u00e0 l'exception des gestionnaires, des personnes au-dessus du rang de gestionnaire, du personnel du bureau des ventes et du personnel de bureau (y compris le personnel de la billetterie et des abonnements et le personnel de l'entr\u00e9e des artistes) et des personnes vis\u00e9es par les conventions collectives en vigueur\".
