Le local a \u00e9t\u00e9 certifi\u00e9 pour <em>\"Tous les machinistes employ\u00e9s par l'employeur au th\u00e9\u00e2tre The Pantages Playhouse dans la province du Manitoba, \u00e0 l'exclusion des employ\u00e9s exclus par la Loi sur les relations de travail\".<\/em>.  Le Th\u00e9\u00e2tre avait d'abord contest\u00e9 qu'il \u00e9tait l'employeur de l'unit\u00e9 de n\u00e9gociation propos\u00e9e (soutenant que les locataires de l'installation \u00e9taient l'employeur), mais a abandonn\u00e9 cet argument au d\u00e9but de l'audience.  La d\u00e9cision de la Commission portait plut\u00f4t sur l'applicabilit\u00e9 de la r\u00e8gle 28 des r\u00e8gles de proc\u00e9dure de la Commission du travail du Manitoba.  (La constitutionnalit\u00e9 de l'article 28 a \u00e9galement \u00e9t\u00e9 soulev\u00e9e par la section locale, mais il a \u00e9t\u00e9 convenu que la question constitutionnelle serait report\u00e9e en attendant que la question de l'applicabilit\u00e9 soit tranch\u00e9e).  La r\u00e8gle 28 pr\u00e9voit la d\u00e9termination du soutien des membres en tant que pourcentage de \"tous les employ\u00e9s qui, \u00e0 la date du d\u00e9p\u00f4t de la demande, sont \u00e0 l'emploi de l'employeur et font partie de l'unit\u00e9...\" et comprend des crit\u00e8res sp\u00e9ciaux pour traiter les employ\u00e9s \u00e0 temps partiel et les employ\u00e9s r\u00e9guliers ou \u00e0 temps plein.  La section locale a r\u00e9ussi \u00e0 faire valoir que les trois machinistes qui \u00e9taient pr\u00e9sents \u00e0 la date de la demande \u00e9taient des employ\u00e9s \u00e0 temps plein et que, par cons\u00e9quent, la r\u00e8gle 28 ne s'appliquait pas.
