Le travail en litige \u00e9tait l'installation et l'enl\u00e8vement de cam\u00e9ras de surveillance vid\u00e9o temporaires et de c\u00e2bles \u00e0 divers endroits \u00e0 Exhibition Place pour l'Exposition nationale canadienne.  La section locale 58 s'est appuy\u00e9e sur une d\u00e9cision ant\u00e9rieure de la Commission, Local 58 v. Board of Governors of Exhibition Place, [2002] OLRB Rep 849, dans laquelle la Commission avait interpr\u00e9t\u00e9 la clause de reconnaissance de la convention de la section locale 58 comme couvrant les travaux de nature temporaire (laissant les travaux de nature permanente \u00e0 la FIOE).
