Le r\u00e8glement de l'affaire consistait \u00e0 d\u00e9terminer si la t\u00e9l\u00e9copie d'un horaire r\u00e9vis\u00e9 contenant la mention \"DARK\" constituait un avis en temps opportun d'un changement de jour de cong\u00e9, conform\u00e9ment \u00e0 l'article 4.03 de la convention collective.  L'arbitre a donn\u00e9 raison \u00e0 la section locale.  En particulier, elle a conclu qu'il n'\u00e9tait pas raisonnable pour l'employeur de conclure que la section locale pouvait discerner, \u00e0 partir du seul horaire r\u00e9vis\u00e9, qu'elle avait l'intention de changer le jour de cong\u00e9 d\u00e9sign\u00e9 du lundi \u00e0 un ou plusieurs autres jours pr\u00e9cis.  L'utilisation du terme \" DARK \" sans la d\u00e9signation suppl\u00e9mentaire de \" No Performance \" ou de \" Designated Day Off \" n'\u00e9tait pas suffisante pour informer la section locale que le jour de cong\u00e9 \u00e9tait modifi\u00e9.  Le terme \"DARK\" signifie seulement qu'il n'y a pas de spectacle pr\u00e9vu, et n'est pas synonyme de jour de cong\u00e9 d\u00e9sign\u00e9.  Lorsqu'il y a normalement deux jours \"DARK\" \u00e0 l'horaire dans une semaine donn\u00e9e, le sens du mot n'est pas \u00e9vident.
