Deux griefs portaient sur la question de savoir si les employ\u00e9s mis \u00e0 pied au milieu de la semaine de travail avaient droit \u00e0 40 heures de r\u00e9mun\u00e9ration (les \"griefs relatifs \u00e0 la mise \u00e0 pied\").  Les deux autres griefs concernent le travail effectu\u00e9 par des b\u00e9n\u00e9voles de deux groupes \u00e0 but non lucratif qui ont emprunt\u00e9 de l'\u00e9quipement \u00e0 l'employeur et ont charg\u00e9 et\/ou d\u00e9charg\u00e9 cet \u00e9quipement dans les locaux de l'employeur (les \"griefs relatifs au travail de l'unit\u00e9 de n\u00e9gociation\").  La question \u00e9tait de savoir si ce travail aurait d\u00fb \u00eatre effectu\u00e9 par des membres du syndicat.<\/p><p><strong>Griefs relatifs aux licenciements<\/strong><\/p><p>L'arbitre Steinberg a conclu que l'article 19.01 de la convention collective, qui pr\u00e9voit que \" les employ\u00e9s \u00e0 temps plein sont r\u00e9mun\u00e9r\u00e9s pour un minimum de quarante (40) heures par semaine \", \u00e9tait manifestement ambigu.  Il a ajout\u00e9 que le paragraphe 19.01 limiterait consid\u00e9rablement le droit de l'employeur de proc\u00e9der \u00e0 des mises \u00e0 pied, droit qui n'est pas qualifi\u00e9 dans les dispositions relatives aux droits de la direction.  Par cons\u00e9quent, l'arbitre Steinberg a jug\u00e9 que lorsqu'un employeur met \u00e0 pied des employ\u00e9s au milieu de la semaine et que l'employeur a <em>de bonne foi <\/em>si la mise \u00e0 pied a lieu en milieu de semaine, l'article 19.01 ne s'applique pas.<\/p><p><strong>Griefs de travail de l'unit\u00e9 de n\u00e9gociation<\/strong><\/p><p>L'arbitre Steinberg a conclu que le d\u00e9placement de pupitres \u00e0 musique, de lumi\u00e8res, de colonnes montantes et de c\u00e2bles sur le quai de chargement et non vers, depuis ou dans le th\u00e9\u00e2tre est couvert par la convention collective.  Toutefois, l'arbitre Steinberg a jug\u00e9 que, puisque le travail ne prenait que cinq minutes, il \u00e9tait couvert par la convention collective. <em>de minimus<\/em>.
