Harris)<br \/>14 mai 2012<\/p><p><strong>Les faits : \u00a0\u00a0 <\/strong><\/p><p>Le syndicat a all\u00e9gu\u00e9 que l'employeur avait enfreint l'article 5.2 de la convention collective, qui stipule que \"pour les postes nouveaux ou ouverts, l'employeur a le droit de choisir le(s) chef(s) de d\u00e9partement et le(s) assistant(s)\", mais que \"la premi\u00e8re consid\u00e9ration sera accord\u00e9e aux titulaires\". La convention collective d\u00e9finit les \"titulaires\" comme \"la personne en poste depuis le plus longtemps qui n'a pas d\u00e9missionn\u00e9 ou n'a pas \u00e9t\u00e9 licenci\u00e9e pour un motif valable\".<\/p><p>En pourvoyant les postes de chef de d\u00e9partement et d'assistant pour la com\u00e9die musicale <em>Billy Elliot<\/em>Dans un premier temps, le chef de la production de l'employeur, Scot Whitham, a lanc\u00e9 un appel \u00e0 toutes les personnes int\u00e9ress\u00e9es par le poste, et pas seulement \u00e0 celles qui \u00e9taient d\u00e9j\u00e0 en poste.  Il a ensuite examin\u00e9 les curriculum vitae soumis et les a transmis \u00e0 l'employeur. <em>Billy Elliot<\/em> pour examen.  M. Whitham a affirm\u00e9 avoir fait ses choix en fonction des exigences de l'\u00e9mission, de l'exp\u00e9rience des candidats, de ce que faisaient les titulaires et des besoins des autres \u00e9missions de l'employeur. Il affirme avoir pris en consid\u00e9ration tous les candidats, mais a fini par laisser passer des employ\u00e9s qualifi\u00e9s ayant plus d'anciennet\u00e9 pour combler les postes de chef et d'assistant chef de la garde-robe et de la coiffure\/du maquillage.<\/p><p><strong>D\u00e9cision :<\/strong><\/p><p>Griefs rejet\u00e9s<\/p><p><strong>Raisonnement :<\/strong><\/p><p>La Commission a estim\u00e9 que l'\"anciennet\u00e9\" n'entrait pas en jeu ici et que l'employeur conservait son droit expr\u00e8s de faire la s\u00e9lection comme il l'entendait, pourvu qu'il accorde la premi\u00e8re consid\u00e9ration aux employ\u00e9s ayant le plus d'anciennet\u00e9.  L'arbitre a jug\u00e9 que le sens de l'expression \"premi\u00e8re consid\u00e9ration\" n'offre pas le type de s\u00e9curit\u00e9 d'emploi que le syndicat recherchait, \u00e0 savoir que le \"titulaire\" ait le premier droit de refus pour tous les nouveaux postes, \u00e0 condition qu'ils ne manquent pas de qualifications sp\u00e9cifiques.<\/p><p>Les cas que le syndicat a cit\u00e9s dans son argumentation font r\u00e9f\u00e9rence \u00e0 des conventions collectives qui favorisent explicitement les candidats internes ou qui contiennent une exigence de processus en deux \u00e9tapes selon laquelle l'employeur doit d'abord examiner les candidats internes avant les candidats externes. Aucune restriction ou exigence de ce genre n'existe dans la pr\u00e9sente convention collective, puisque le libell\u00e9 en cause est \" premi\u00e8re consid\u00e9ration \" et non \" premi\u00e8re consid\u00e9ration avant \". En outre, la convention collective ne pr\u00e9voit pas de \"seuil d'aptitude\" d\u00e9taill\u00e9 qui indique comment l'employeur doit faire son choix.<\/p><p>La Commission a estim\u00e9 que M. Whitham a pris sa d\u00e9cision de mani\u00e8re non arbitraire, en consid\u00e9rant d'abord les titulaires dans le contexte du travail disponible, de ce que les titulaires faisaient, des spectacles \u00e0 venir dans les quatre th\u00e9\u00e2tres de l'employeur et des exigences de l'emploi. <em>Billy Elliot<\/em>. Il a envoy\u00e9 tous les curriculum vitae au personnel du salon, les a inform\u00e9s de ceux qui \u00e9taient des employ\u00e9s et de ceux qui ne l'\u00e9taient pas et il a pris sa d\u00e9cision finale seulement apr\u00e8s avoir accord\u00e9 la premi\u00e8re consid\u00e9ration requise aux titulaires. Ayant agi ainsi, M.
