Le syndicat a fait valoir que l'article 7.01 de la convention collective entre les parties exige un paiement minimum de quatre heures pour ce travail. L'employeur a fait valoir que les salari\u00e9s n'avaient le droit qu'au paiement de leur taux horaire pour les heures effectivement travaill\u00e9es.<\/p><p>L\u2019article 7.01 de la convention collective pr\u00e9voit:\u00a0<\/p><p><em>\u201cThe commencement time for calls can be staggered in accordance with NYPACC\u2019s operational needs.  The commencement time for a stage employees call is specific to each stage employee and shall continue until NYPACC no longer requires that stage employee\u2019s services or until the stage employee has had an unpaid break in excess of three (3) hours.  Four (4) hours shall constitute the minimum call.\u201d<\/em><\/p><p>Apr\u00e8s avoir examin\u00e9 le vocabulaire de la convention, l'arbitre a accueilli le grief et a conclu que l\u2019article 7 de la convention collective, lorsque consid\u00e9r\u00e9 globalement, pr\u00e9voit qu\u2019un appel de performance est termin\u00e9 lorsque les services du salari\u00e9 ne sont plus n\u00e9cessaires pour les fins de l\u2019appel initial.
