Jusqu\u2019en 2013, au cours de cette p\u00e9riode, certains employ\u00e9s assign\u00e9s \u00e0 un spectacle au CNE travaillaient de 18 \u00e0 25 jours sans cong\u00e9. En 2013, l\u2019employeur a chang\u00e9 sa pratique afin de pr\u00e9voir des jours de cong\u00e9.<\/p><p class=\" translation-block\">L\u2019employeur a fait valoir qu'il a d\u00fb modifier l\u2019horaire afin de se conformer \u00e0 l'article 18(4) de la Loi de 2000 sur les normes d\u2019emploi qui pr\u00e9voit une pause de 24 heures chaque semaine et 48 heures cheque deux semaines. L\u2019IATSE a fait valoir que l\u2019ancienne pratique d\u2019\u00e9tablissement des horaires de travail n\u2019enfreigne pas la Loi et fait valoir, en outre, que la pratique d\u2019\u00e9tablissement des horaires de travail est une pratique de longue date qui a rest\u00e9 inchang\u00e9s et qui ne peut pas \u00eatre modifi\u00e9 jusqu'\u00e0 l\u2019expiration de la convention collective.<\/p><p>L'arbitre a accueilli le grief. Ce faisant, l\u2019arbitre a jug\u00e9 que dans ce cas, l\u2019article 18 (4) de la Loi est une disposition de laquelle l\u2019employeur peut choisir de se retirer.  En ce qui concerne l\u2019argument de l'estoppel, l\u2019arbitre a jug\u00e9 que \u00ab tous les \u00e9l\u00e9ments pour \u00e9tablir un estoppel sont pr\u00e9sents, compte tenu la pratique de longue date et consistante d\u2019\u00e9tablissement des horaires. \u00bb Par cons\u00e9quent, l\u2019arbitre a ordonn\u00e9 \u00e0 l\u2019employeur de retourner \u00e0 son ancienne pratique d\u2019\u00e9tablissement des horaires de travail pendant le CNE. Par cons\u00e9quent, \u00ab les employ\u00e9s qui se portent volontaires pour travailler les heures de la pr\u00e9sente horaire, conform\u00e9ment aux termes de la pratique, auront le droit de le faire. \u00bb<\/p><p><a
