Le CRT a ordonn\u00e9 \u00e0 l\u2019arbitre de fournir des motifs concernant sa comp\u00e9tence \u00e0 \u00e9mettre une d\u00e9cision relativement aux dispositions de licenciement.\u00a0<\/p><p>En f\u00e9vrier 2005, l\u2019arbitre Ready \u00e9tait nomm\u00e9 commissaire d\u2019enqu\u00eate sur les relations du travail (\u00ab CERT \u00bb) par le ministre du Travail. Avant cela, en 2003, le Juge Tysoe \u00e9tait nomm\u00e9 CERT de l\u2019industrie cin\u00e9matographique. Agissant en cette qualit\u00e9, il a publi\u00e9 un rapport sur l\u2019industrie cin\u00e9matographique de la Colombie-Britannique (\u00ab le rapport Tysoe \u00bb). Le rapport Tysoe recommandait notamment que le syst\u00e8me de r\u00e9partition fond\u00e9 sur l\u2019anciennet\u00e9 soit remplac\u00e9 par un syst\u00e8me de demande de main-d\u2019\u0153uvre nominale. Suite au rapport Tysoe, les parties se sont r\u00e9unies et ont pu r\u00e9soudre les questions autour de la mise en \u0153uvre des recommandations du rapport Tysoe, \u00e0 l\u2019exception de celle de l\u2019abolissement du syst\u00e8me de r\u00e9partition \u00e0 l\u2019anciennet\u00e9. Cela a conduit \u00e0 la nomination de l\u2019arbitre Ready au poste de CERT. Les parties \u00e9taient contre la mise en \u0153uvre de ces recommandations, et, par cons\u00e9quent, l\u2019arbitre a \u00e9t\u00e9 nomm\u00e9 CERT en vertu du Code. L\u2019arbitre a mis en place des lignes de conduite pour les n\u00e9gociations et a d\u00e9clar\u00e9 que la question de la r\u00e9partition \u00e0 l\u2019anciennet\u00e9 pouvait \u00eatre renvoy\u00e9e \u00e0 un arbitre pour arbitrage ex\u00e9cutoire. L\u2019AIEST 891 est parvenu \u00e0 une entente avec l\u2019Employeur, apr\u00e8s n\u00e9anmoins que Teamsters n\u2019aient pas r\u00e9ussi \u00e0 parvenir \u00e0 une entente. L\u2019AIEST 891 a ensuite cherch\u00e9 \u00e0 retirer son offre. L\u2019affaire fut transmise pour arbitrage ex\u00e9cutoire.<\/p><p>Dans le jugement de la r\u00e9partition \u00e0 l\u2019anciennet\u00e9, l\u2019arbitre a soutenu que l\u2019AIEST 891 ne pouvait pas revenir sur son accord original. Suite \u00e0 la prononciation du jugement de la r\u00e9partition \u00e0 l\u2019anciennet\u00e9, l\u2019Employeur a \u00e9crit \u00e0 l\u2019arbitre pour demander des pr\u00e9cisions sur trois questions, notamment celle visant \u00e0 d\u00e9terminer si les licenciements suivront le m\u00eame ordre que le syst\u00e8me de r\u00e9partition. Suite \u00e0 la r\u00e9ception de la lettre de l\u2019Employeur, l\u2019AIEST 891 a fait opposition au jugement de l\u2019arbitre sur le point soulev\u00e9 par l\u2019Employeur affirmant que la question de l\u2019ordre de licenciement n\u2019\u00e9tait pas pr\u00e9sent\u00e9e devant l\u2019arbitre et que, de ce fait, l\u2019arbitre n\u2019\u00e9tait pas mandat\u00e9 pour trancher ce sujet. L\u2019arbitre a d\u00e9cid\u00e9 en faveur de l\u2019Employeur, sans pour autant fournir de motifs pour sa d\u00e9cision selon laquelle il a l\u2019autorit\u00e9 pour s\u2019occuper de cette question. Comme expliqu\u00e9 ci-dessus, une demande a \u00e9t\u00e9 d\u00e9pos\u00e9e aupr\u00e8s du CRT au sujet du mandat de l\u2019arbitre. Le CRT a ordonn\u00e9 \u00e0 l\u2019arbitre de fournir des motifs pour sa conclusion selon laquelle son mandat lui permettait de s\u2019occuper des questions de licenciement.<\/p><p>Depuis le jugement original, les parties ont conclu une succession de conventions collectives pour les p\u00e9riodes du 29 mars 2009 au 31 mars 2012 et du 1er avril 2012 au 31 mars 2015.<\/p><p>Suite \u00e0 l\u2019ordonnance du Conseil prescrivant que l\u2019arbitre Vincent Ready fournisse des motifs pour sa conclusion au sujet de son mandat, l\u2019Employeur a soulev\u00e9 un moyen pr\u00e9liminaire portant que la question \u00e9tait d\u00e9sormais sans int\u00e9r\u00eat pratique et n\u2019avait pas besoin d\u2019\u00eatre d\u00e9cid\u00e9e.<\/p><p><strong>La d\u00e9cision<\/strong><\/p><p>L\u2019arbitre a d\u00e9clar\u00e9 que la question \u00e9tait de son ressort parce qu\u2019en tant qu\u2019arbitre de diff\u00e9rends, son r\u00f4le \u00e9tait de \u00ab r\u00e9pliquer ce qu\u2019une n\u00e9gociation conventionnelle aurait produit, et deuxi\u00e8mement, de d\u00e9terminer ce qui est juste et raisonnable. \u00bb Ainsi, puisque la question des licenciements faisait l\u2019objet de n\u00e9gociations entre les parties, l\u2019arbitre a d\u00e9clar\u00e9 que ces questions relevaient de sa comp\u00e9tence. De plus, il a not\u00e9 que dans sa d\u00e9cision initiale, il restait saisi des questions d\u2019interpr\u00e9tation et de mise en \u0153uvre. La seconde d\u00e9cision concernait l\u2019interpr\u00e9tation et la mise en \u0153uvre.<\/p><p>Pour ce qui est de la question du manque d\u2019int\u00e9r\u00eat, l\u2019arbitre a conclu que la question manque d\u2019int\u00e9r\u00eat car elle n\u2019aura pas d\u2019effet pratique sur les droits des parties et n\u2019aidera pas \u00e0 r\u00e9soudre de question par la suite. Ce faisant, l\u2019arbitre a not\u00e9 que la terminologie de la convention collective sur laquelle sa premi\u00e8re d\u00e9cision portait a depuis expir\u00e9, et que les parties ont ratifi\u00e9 une nouvelle convention collective. L\u2019arbitre note que, bien que les parties ont eu l\u2019opportunit\u00e9 de modifier la terminologie\/les concepts du jugement initial dans les n\u00e9gociations ult\u00e9rieures, elles ont choisi de retenir cette terminologie.
