Pour la section locale 891, les chefs de d\u00e9partements comprenaient le Concepteur artistique, le Cr\u00e9ateur de costume, le Coordinateur de construction, le Chef accessoiriste, le Directeur de plateau et Effets sp\u00e9ciaux. Les parties se sont accord\u00e9es sur le fait que, bien que Stage 49 Ltd. ait sign\u00e9 les deux lettres d\u2019adh\u00e9sion de ces productions, chaque production repr\u00e9sentait un employeur distinct.<\/p><p>La disposition appropri\u00e9e de la Convention collective de l\u2019AIEST est l\u2019article A1.08 qui \u00e9nonce ce qui suit :<\/p><p style=\"padding-left: 40px;\">\u00ab Chef de d\u00e9partement : chaque d\u00e9partement utilis\u00e9 par un employeur au sein d\u2019une production devra avoir un Chef de d\u00e9partement qui est membre de ce d\u00e9partement particulier \u00e0 moins que le permis de travail soit accord\u00e9 via les permis de l\u2019article 3. \u00bb<\/p><p>L\u2019employeur a d\u00e9clar\u00e9 que les chefs de d\u00e9partement cumulaient les fonctions parce que les deux productions avaient des immobilisations en commun, telles que les machines, les sc\u00e8nes et les bureaux. Par ailleurs, les synopsis \u00e9taient similaires, l\u2019aspect cr\u00e9atif \u00e9tait le m\u00eame, les personnages se chevauchaient, et les productions avaient les m\u00eames sc\u00e8nes, accessoires et effets sp\u00e9ciaux.<\/p><p>L\u2019arbitre a soutenu que le texte simple et lit\u00e9ral de l\u2019article A1.08 ne traitait pas de la question du cumul des fonctions. De plus, l\u2019arbitre a conclu que le pratique ant\u00e9rieure consistait \u00e0 autoriser les chefs de d\u00e9partements \u00e0 cumuler les fonctions.
