Gould depuis sa cr\u00e9ation en 2010.<\/p><p>Premi\u00e8rement, l'arbitre a examin\u00e9 ce que pr\u00e9voyait la convention collective \u00e0 l'\u00e9gard de l'\u00e9limination d'un poste d'unit\u00e9 de n\u00e9gociation. La convention collective ne pr\u00e9voyait aucun droit de supplantation entre d\u00e9partements, mais exigeait que les employ\u00e9s soient licenci\u00e9s dans l'ordre inverse de l'anciennet\u00e9 par d\u00e9partement. Elle a jug\u00e9 que l'employeur avait respect\u00e9 ses obligations en vertu de la convention collective en permettant \u00e0 M. Gould de supplanter un employ\u00e9 moins anicien dans de d\u00e9partement de la conciergerie. Deuxi\u00e8mement, l'arbitre a constat\u00e9 que l'employeur a exerc\u00e9 de bonne foi sa pr\u00e9rogative patronale lorsqu'il a licenci\u00e9 le superviseur des installations et que sa d\u00e9cision a \u00e9t\u00e9 prise pour des motifs commerciaux raisonnables. En outre, elle a jug\u00e9 que les fonctions du superviseur des installations n'\u00e9taient pas au c\u0153ur de l'unit\u00e9 de n\u00e9gociation et l'int\u00e9grit\u00e9 de l'unit\u00e9 de n\u00e9gociation n'a pas \u00e9t\u00e9 compromise lorsque l'employeur a \u00e9limin\u00e9 ce poste.<\/p><p>L'arbitre a conclu que la convention collective n'avait pas \u00e9t\u00e9 viol\u00e9e et a rejet\u00e9 les griefs.
