La requ\u00eate a \u00e9t\u00e9 d\u00e9pos\u00e9e en champs libre et le litige devant la CRT ne portait que sur la description de l\u2019unit\u00e9 de n\u00e9gociation.<\/p><p>L\u2019employeur soutenait que l\u2019unit\u00e9 de n\u00e9gociation devait inclure aussi les salari\u00e9s travaillant \u00e0 l\u2019entrep\u00f4t, au Temple de la Renomm\u00e9e du Centre Bell ainsi que ceux travaillant \u00e0 la boutique souvenir du Complexe Sportif de Brossard. Selon l\u2019employeur, l\u2019exclusion de ces salari\u00e9s rendait l\u2019unit\u00e9 inappropri\u00e9e car elle ne respectait pas l\u2019organisation du travail ni la communaut\u00e9 d\u2019int\u00e9r\u00eats du groupe \u00e9largi.<\/p><p>La CRT rappelle qu\u2019un groupe distinct sera jug\u00e9 appropri\u00e9 lorsqu\u2019il peut \u00e9tablir des rapports collectifs de travail utiles avec l\u2019employeur. La Commission n\u2019a pas \u00e0 d\u00e9terminer si une autre unit\u00e9 serait aussi ou plus appropri\u00e9e que celle demand\u00e9e par le syndicat mais seulement d\u00e9cider si l\u2019unit\u00e9 demand\u00e9e est en soi appropri\u00e9e.<\/p><p>En l\u2019esp\u00e8ce, les boutiques fonctionnent de fa\u00e7on autonome et la mobilit\u00e9 du personnel est r\u00e9duite. Les transferts sont ponctuels et occasionnels. Les deux boutiques sont s\u00e9par\u00e9es g\u00e9ographiquement et la stabilit\u00e9 des salari\u00e9s dans chaque milieu cr\u00e9e un environnement de travail coh\u00e9rent. Quant au Temple de la Renomm\u00e9e, il se trouve sur un \u00e9tage diff\u00e9rent et a une logique op\u00e9rationnelle qui lui est propre. Il n\u2019y a aucune interchangeabilit\u00e9 de fonctions. En ce qui a trait \u00e0 l\u2019entrep\u00f4t, il y a une mobilit\u00e9 de personnel tr\u00e8s limit\u00e9e. Il n\u2019y a pas de communaut\u00e9 d\u2019int\u00e9r\u00eats entre les salari\u00e9s de l\u2019entrep\u00f4t et ceux de la boutique.<\/p><p>Biens qu\u2019il y aurait une coexistence possible de plusieurs conventions collectives, cela ne suffit pas selon la CRT \u00e0 \u00e9carter les autres crit\u00e8res d\u2019appr\u00e9ciation. En somme, l\u2019unit\u00e9 demand\u00e9e par le syndicat est appropri\u00e9e en raison de la communaut\u00e9 d\u2019int\u00e9r\u00eats des salari\u00e9s de la boutique, de l\u2019historique des accr\u00e9ditations marqu\u00e9 par une multiplicit\u00e9 d\u2019unit\u00e9s chez cet employeur, de l\u2019absence de menace pour la paix industrielle et enfin de la volont\u00e9 des salari\u00e9s d\u2019une boutique assimilable \u00e0 un magasin.<\/p><p>L\u2019accr\u00e9ditation est accord\u00e9e.<\/p><p><a
