L'employeur a contest\u00e9 la description de l'unit\u00e9 de n\u00e9gociation propos\u00e9e par le syndicat, en faisant valoir que les cinq chefs de production ne devaient pas \u00eatre inclus dans l'unit\u00e9 de n\u00e9gociation parce qu'ils exer\u00e7aient le pouvoir de gestion d'embaucher des employ\u00e9s occasionnels. La Commission a conclu que m\u00eame si les chefs de production exer\u00e7aient ce pouvoir de gestion, un certain nombre de facteurs militaient en faveur de leur inclusion dans l'unit\u00e9 de n\u00e9gociation.  Premi\u00e8rement, le pouvoir d'embauche des chefs de production se limitait \u00e0 l'embauche d'employ\u00e9s occasionnels pour des p\u00e9riodes intermittentes, \u00e0 partir d'un bassin \u00e9tabli d'employ\u00e9s occasionnels. Deuxi\u00e8mement, les chefs de production avaient tr\u00e8s peu de pouvoir pour d\u00e9terminer les conditions d'emploi qu'ils offraient aux employ\u00e9s occasionnels qu'ils embauchaient. Troisi\u00e8mement, les fonctions d'embauche des chefs de production n'\u00e9taient que des responsabilit\u00e9s suppl\u00e9mentaires \u00e0 leurs fonctions principales, qui \u00e9taient celles d'un employ\u00e9 qualifi\u00e9 des m\u00e9tiers de la production. Quatri\u00e8mement, l'exclusion des chefs de production de l'unit\u00e9 de n\u00e9gociation affaiblirait et diviserait l'unit\u00e9 de n\u00e9gociation des m\u00e9tiers en cr\u00e9ant un nombre disproportionn\u00e9 de postes exclus d'une petite unit\u00e9 de n\u00e9gociation, et serait contraire \u00e0 la politique de la Commission d'accorder des exceptions relatives \u00e0 la gestion qui sont aussi \u00e9troites que possible.<\/p><p>L'employeur a \u00e9galement contest\u00e9 l'exclusion du scrutin de repr\u00e9sentation de six employ\u00e9s qui, selon le syndicat, \u00e9taient inadmissibles parce qu'ils ne travaillaient pas dans le service de production au moment en question, et les deux parties ont pr\u00e9sent\u00e9 des observations sur la question de savoir si d'autres employ\u00e9s avaient \u00e9t\u00e9 trait\u00e9s \u00e0 tort comme \u00e9tant inadmissibles au scrutin en raison de leurs ant\u00e9c\u00e9dents professionnels dans le service de production.
