La question en litige dans cette d\u00e9cision \u00e9tait de savoir si la demande d'accr\u00e9ditation \u00e9tait prescrite, car l'employeur et l'intervenant, le Syndicat canadien de la fonction publique, section locale 905 (\" SCFP \"), ont all\u00e9gu\u00e9 que les \" machinistes \" \u00e9taient d\u00e9j\u00e0 repr\u00e9sent\u00e9s par le SCFP et couverts par leur convention collective qui n'expirait que le 31 mars 2013.<\/p><p>Le Conseil a jug\u00e9 que la demande de l'IATSE \u00e9tait prescrite en vertu de l'article 7(4) de la Loi sur les relations de travail dans la fonction publique. <em>Relations de travail <\/em><\/p><p><em>Acte <\/em>puisque les machinistes \u00e9taient couverts par la convention collective du SCFP.  Pour en arriver \u00e0 cette conclusion, la Commission a tenu compte du fait que le SCFP et Richmond Hill avaient envisag\u00e9 que le SCFP repr\u00e9sente les machinistes, comme en t\u00e9moigne une lettre d'entente sign\u00e9e en 2008 r\u00e9gissant la fa\u00e7on dont les machinistes seraient r\u00e9gis par la convention collective du SCFP.  De plus, la Commission a jug\u00e9 que les machinistes sont plausiblement inclus dans la clause de reconnaissance de la convention collective du SCFP pour une \"unit\u00e9 de n\u00e9gociation \u00e0 temps plein pour tous les employ\u00e9s\".  La combinaison de la port\u00e9e de la clause de reconnaissance et de la lettre d'entente de 2008 \u00e9tait suffisante pour que la Commission d\u00e9termine que les machinistes \u00e9taient couverts par la convention du SCFP.
