Eggs Films a une soci\u00e9t\u00e9 s\u0153ur qui a le m\u00eame propri\u00e9taire et la m\u00eame direction.  Le projet qui a conduit \u00e0 cette demande de certification \u00e9tait un \"tournage\" d'une journ\u00e9e.  Il s'agissait d'un projet important qui a n\u00e9cessit\u00e9 l'embauche d'environ 25 personnes, dont plusieurs \u00e9taient des membres du requ\u00e9rant.<\/p><p>La d\u00e9cision examine les quatre questions suivantes :<\/p><ol><li style=\"list-style-type: none;\"><ol><li>Les techniciens du cin\u00e9ma \u00e9taient-ils des employ\u00e9s ou des entrepreneurs ind\u00e9pendants ?<\/li><li>L'unit\u00e9 de n\u00e9gociation recherch\u00e9e est-elle appropri\u00e9e pour la n\u00e9gociation collective ?<\/li><li>La demande porte sur une unit\u00e9 artisanale qui n'est pas conforme au r\u00e8glement sur les unit\u00e9s artisanales ?<\/li><li>La demande enfreint-elle la politique de la Commission qui limite l'\u00e9ligibilit\u00e9 des \u00e9lecteurs aux employ\u00e9s au travail \u00e0 la fois \u00e0 la date de la demande et \u00e0 la date du vote ?<\/li><\/ol><\/li><\/ol><p>Question 1 : Les techniciens du cin\u00e9ma \u00e9taient-ils des employ\u00e9s ou des entrepreneurs ind\u00e9pendants ?<\/p><p>La Commission a statu\u00e9 que le fait que plusieurs de ces personnes ne d\u00e9pendent pas de cet employeur particulier pour la majorit\u00e9 de leur emploi n'est pas d\u00e9terminant.  Ce faisant, la Commission a \u00e9tabli une analogie entre la relation d'emploi des techniciens du cin\u00e9ma et les employ\u00e9s qui exercent des m\u00e9tiers sp\u00e9cialis\u00e9s dans l'industrie de la construction.  La Commission a \u00e9galement soutenu que l'industrie de la publicit\u00e9 commerciale et d'entreprise fait partie de l'industrie cin\u00e9matographique aux fins de l'application de la Loi sur les normes d'emploi. <em>Agir.<\/em>\u00a0 La Commission a \u00e9galement conclu qu'en ce qui concerne le travail effectu\u00e9 \u00e0 la date de d\u00e9p\u00f4t de la demande, les techniciens, tout en utilisant leurs diverses comp\u00e9tences pour faire fonctionner leur \u00e9quipement particulier, l'ont fait sous la direction \u00e9troite du producteur d\u00e9l\u00e9gu\u00e9 et du directeur de la photographie.  Par cons\u00e9quent, la Commission a conclu que les \" techniciens en cin\u00e9ma \" employ\u00e9s par Egg Films le 5 mars 2011 \u00e9taient des employ\u00e9s au sens de la Loi sur les normes d'emploi. <em>Agir.<\/em><\/p><p>Question 2 : L'unit\u00e9 de n\u00e9gociation recherch\u00e9e est-elle appropri\u00e9e pour la n\u00e9gociation collective ?<\/p><p>La Commission a soutenu que sa t\u00e2che consiste \u00e0 d\u00e9limiter \"une unit\u00e9 de n\u00e9gociation appropri\u00e9e\" et non \"l'unit\u00e9 de n\u00e9gociation la plus appropri\u00e9e\" en tenant compte de la communaut\u00e9 d'int\u00e9r\u00eats.  La Commission a d\u00e9clar\u00e9 qu'au Canada, les \"techniciens du cin\u00e9ma\" excluent normalement les producteurs d\u00e9l\u00e9gu\u00e9s et les op\u00e9rateurs de cam\u00e9ra.  La Commission a \u00e9galement conclu que l'unit\u00e9 de n\u00e9gociation figurant dans la demande d'accr\u00e9ditation est une unit\u00e9 de n\u00e9gociation appropri\u00e9e.  Toutefois, la Commission a accept\u00e9 d'entendre d'autres arguments sur les tenants et aboutissants de cette demande particuli\u00e8re.<\/p><p>De plus, la Commission s'est pench\u00e9e sur la question de savoir si elle devait consid\u00e9rer une unit\u00e9 d'\"employ\u00e9s occasionnels\" comme appropri\u00e9e pour la n\u00e9gociation collective.  La Commission a estim\u00e9 que dans ce cas, les int\u00e9r\u00eats des employ\u00e9s occasionnels ne sont pas contraires \u00e0 ceux des employ\u00e9s \u00e0 temps plein.  De plus, elle a conclu que les employ\u00e9s occasionnels font un travail diff\u00e9rent de celui des employ\u00e9s \u00e0 temps plein.  Par cons\u00e9quent, la Commission a conclu que l'unit\u00e9 de n\u00e9gociation demand\u00e9e \u00e9tait appropri\u00e9e tant sur le plan de la composition que de la continuit\u00e9.<\/p><p>Question 3 : La demande porte-t-elle sur une unit\u00e9 artisanale qui ne respecte pas le r\u00e8glement sur les unit\u00e9s artisanales ?<\/p><p>La Commission a jug\u00e9 que l'article 24 de la <em>Acte<\/em> et ses r\u00e8glements connexes ne s'appliquent pas \u00e0 l'industrie cin\u00e9matographique en Nouvelle-\u00c9cosse.  En particulier, la Commission a soutenu que le Craft Unit Regulations \"n'a jamais \u00e9t\u00e9 con\u00e7u pour s'appliquer \u00e0 des unit\u00e9s professionnelles comme les techniciens de cin\u00e9ma, les projectionnistes, les machinistes ou les musiciens\". La Commission a soutenu que l'article 24 vise \u00e0 emp\u00eacher la cr\u00e9ation de petites unit\u00e9s artisanales qui peuvent jeter un \"b\u00e2ton dans les roues, pour ainsi dire, des grands travaux industriels d'une entreprise et de ses \"employ\u00e9s dans leur ensemble\"\".<\/p><p>Question 4 : La demande enfreint-elle la politique de la Commission qui limite l'\u00e9ligibilit\u00e9 des \u00e9lecteurs aux employ\u00e9s au travail \u00e0 la fois \u00e0 la date de la demande et \u00e0 la date du vote ?<\/p><p>La Commission a estim\u00e9 que l'\u00e9ligibilit\u00e9 des \u00e9lecteurs devait \u00eatre limit\u00e9e \u00e0 une date pr\u00e9cise dans l'industrie de la \"production cin\u00e9matographique\/commerciale\".
