Le m\u00eame jour, le Syndicat a d\u00e9pos\u00e9 une nouvelle demande d'accr\u00e9ditation concernant la m\u00eame unit\u00e9 de n\u00e9gociation.<\/p><p>L'Employeur s'est oppos\u00e9 \u00e0 la demande d'accr\u00e9ditation. Il a demand\u00e9 \u00e0 la Commission de reconsid\u00e9rer sa d\u00e9cision dat\u00e9e du 16 janvier 2017 et de la modifier en ajoutant un libell\u00e9 qui emp\u00eacherait le Syndicat de d\u00e9poser une nouvelle demande d'accr\u00e9ditation pour une p\u00e9riode n'exc\u00e9dant pas 10 mois \u00e0 compter de la date de rejet de la demande d'accr\u00e9ditation.<\/p><p class=\" translation-block\">La Commission a rejet\u00e9 la demande de l'Employeur visant \u00e0 ce que le Syndicat fasse l'objet d'un d\u00e9lai. La Loi sur les relations industrielles du Nouveau-Brunswick donne \u00e0 la Commission le pouvoir d'interdire aux requ\u00e9rants qui ont d\u00e9pos\u00e9 des demandes d'accr\u00e9ditation infructueuses un nouveau d\u00e9p\u00f4t pour une p\u00e9riode n'exc\u00e9dant pas dix mois. En outre, l'Employeur n'a pas soulev\u00e9 la question de la prescription pendant l'audition de la demande ant\u00e9rieure. Plut\u00f4t, il a attendu que le Syndicat d\u00e9pose la pr\u00e9sente demande pour soulever la question. La Commission a not\u00e9 que le d\u00e9lai pr\u00e9voyait une \u00abp\u00e9riode de r\u00e9flexion\u00bb et a examin\u00e9 l'ampleur des perturbations sur le lieu de travail qui d\u00e9couleraient suite \u00e0 la demande initiales et \u00e0 la demande ult\u00e9rieures. Le seul argument avanc\u00e9 par l'Employeur \u00e9tait l'affirmation qu'ils avaient soumis \u00e0 un gel pr\u00e9vu par la loi depuis septembre 2016.
