La Commission a refus\u00e9 de d\u00e9clarer que la section locale 891 de l'AEIST avait abandonn\u00e9 ses droits de n\u00e9gociation dans les circonstances. L'employeur, NASCO Staffing Solutions, op\u00e9rait une entreprise de travailleurs int\u00e9rimaires. Le syndicat a certifi\u00e9 avec succ\u00e8s une unit\u00e9 de n\u00e9gociation compos\u00e9e d'employ\u00e9s de membres de la production, du personnel technique, du personnel de montage et de d\u00e9montage en 2009.<\/p><p>Les parties ont ratifi\u00e9 une convention collective qui a pris fin en d\u00e9cembre 2012. Cependant, en 2011, il n'y avait aucun employ\u00e9 dans l'unit\u00e9 de n\u00e9gociation. Le syndicat a examin\u00e9 si le travail de l'unit\u00e9 de n\u00e9gociation \u00e9tait en cours et n'a pas pr\u00e9sent\u00e9 de grief.<\/p><p>L'employeur a soutenu que le syndicat a abandonn\u00e9 ses droits de n\u00e9gociation en raison de la p\u00e9riode d'inactivit\u00e9 li\u00e9e \u00e0 l'administration de la convention collective, d'un effort minimal pour renouveler la convention collective et du d\u00e9faut de recourir aux dispositions relatives aux griefs et aux arbitrages. Le Syndicat a soutenu que les parties avaient d\u00e9j\u00e0 convenu qu'il n'\u00e9tait pas n\u00e9cessaire de ren\u00e9gocier une entente alors qu'il n'y avait aucun membre qui accomplissait le travail de l'unit\u00e9 de n\u00e9gociation et que le syndicat ne pouvait pas savoir que le travail \u00e9tait en cours.<\/p><p>La Commission a rejet\u00e9 les arguments de l'employeur et a refus\u00e9 de r\u00e9voquer l'unit\u00e9. La Commission a not\u00e9 qu'il n'\u00e9tait pas contest\u00e9 que l'employeur n'employait aucun employ\u00e9 pour effectuer des travaux d'unit\u00e9 de n\u00e9gociation depuis 2011. La Commission a conclu que, s'il ne semble y avoir aucun travail d'unit\u00e9 de n\u00e9gociation, ce n'est pas d\u00e9raisonnable pour un syndicat de ne pas \u00eatre particuli\u00e8rement actif en ce qui concerne une certification m\u00eame si cette inactivit\u00e9 dure quelques ann\u00e9es. Les parties ont discut\u00e9 de la n\u00e9gociation collective en 2012 et ont convenu qu'un renouvellement n'\u00e9tait pas n\u00e9cessaire.
