Durant la campagne, l'employeur avait envoy\u00e9 deux m\u00e9mos aux salari\u00e9s concernant la campagne de syndicalisation.<\/p><p class=\" translation-block\">Le 8 septembre 2017, suite \u00e0 une requ\u00eate d\u00e9pos\u00e9 par le syndicat au Tribunal afin de faire cesser l'entrave de l'employeur \u00e0 l'\u00e9gard d'une association de salaries et faire cesser l'intimidation \u00e0 l'\u00e9gard des salaries contrairement aux articles 3 et 12 \u00e0 14 du Code du travail, le Tribunal a ordonn\u00e9 \u00e0 l'employeur de cesser de communiquer par \u00e9crit avec ses salari\u00e9s pour discuter, directement ou indirectement, la pr\u00e9sente campagne de syndicalisation.<\/p><p class=\" translation-block\">L'employeur a d\u00e9pos\u00e9 une requ\u00eate en r\u00e9vision en vertu de l'article 49(3) de la Loi instituant le Tribunal administratif du travail contestant la d\u00e9cision du Tribunal du 22 septembre, 2017.<\/p><p class=\" translation-block\">Le Tribunal a rejet\u00e9 la demande de l'employeur. Il a conclu que les salari\u00e9s \u00e9taient captifs des deux m\u00e9mos de l'employeur. De plus, les m\u00e9mos contrevenaient \u00e0 l'article 12 du Code de travail puisqu'ils cherchaient \u00e0 persuader les salari\u00e9s \u00e0 ne pas adh\u00e9rer et \u00e0 r\u00e9silier leur carte de membre du syndicat. En outre, les m\u00e9mos visaient \u00e0 nuire aux d\u00e9marches du syndicat dans son processus de recrutement.
