Le syndicat avait demand\u00e9 une unit\u00e9 de n\u00e9gociation compos\u00e9e de techniciens en audiovisuel et de gr\u00e9eurs travaillant r\u00e9guli\u00e8rement au Sheraton Centre de Toronto, alors que l'employeur a adopt\u00e9 la position qu'une unit\u00e9 compos\u00e9e de tous les salari\u00e9s dans la ville de Toronto \u00e9tait appropri\u00e9e. La Commission a rejet\u00e9 chacun des arguments de l'employeur et a rejet\u00e9 la demande d'examen.<\/p><p>L'employeur a pr\u00e9sent\u00e9 plusieurs arguments \u00e0 l'appui de sa demande de r\u00e9examen. La Commission a rejet\u00e9 chacun de ces arguments, r\u00e9it\u00e9rant que les motifs pour lesquels la Commission reconsid\u00e9rerait une d\u00e9cision sont \u00e9troits. Dans l'int\u00e9r\u00eat de la finalit\u00e9, la Commission exercera son pouvoir de r\u00e9examen qu'en mod\u00e9ration. Il ne s'agit pas d'une occasion pour remettre en litige une affaire qui a d\u00e9j\u00e0 \u00e9t\u00e9 tranch\u00e9e.<\/p><p>D'abord, l'employeur a soutenu que la Commission n'avait pas examin\u00e9 le caract\u00e8re appropri\u00e9 de l'unit\u00e9 de n\u00e9gociation demand\u00e9e par le syndicat. La Commission a refus\u00e9 de modifier la d\u00e9cision en se fondant sur cet argument, car elle avait clairement consid\u00e9r\u00e9 ant\u00e9rieurement l'unit\u00e9 de n\u00e9gociation demand\u00e9e par le syndicat. De plus, la Commission n'est pas tenue de consid\u00e9rer la pertinence d'une unit\u00e9 uniquement en se r\u00e9f\u00e9rant uniquement \u00e0 la description \u00e9crite de l'unit\u00e9 de n\u00e9gociation et \u00e0 rien d'autre.<\/p><p>De plus, l'employeur a soutenu que la Commission devrait reconsid\u00e9rer sa d\u00e9cision parce que, dans sa d\u00e9cision initiale, elle avait erron\u00e9ment renvers\u00e9 le fardeau de la preuve. La Commission a refus\u00e9 de r\u00e9examiner sa d\u00e9cision en fonction de cet argument car elle ne s'est pas fond\u00e9e sur le fardeau de la preuve pour prendre sa d\u00e9cision.\u00a0<\/p><p>L'employeur a \u00e9galement soutenu que la Commission n'a pas tenu compte de certains \u00e9l\u00e9ments de preuve, n'a pas \u00e9valu\u00e9 ad\u00e9quatement les preuves d'interchangeabilit\u00e9 de salari\u00e9s et a tir\u00e9 des conclusions erron\u00e9es. Sur ce point, la Commission a conclu que ces arguments auraient pu \u00eatre pr\u00e9sent\u00e9s ou avaient \u00e9t\u00e9 pr\u00e9sent\u00e9s \u00e0 l'audience. La Commission \u00e9tait en droit de rejeter ces arguments.
