Dans une d\u00e9cision ant\u00e9rieure dat\u00e9e du 15 septembre 2017, la Commission avait conclu que l'unit\u00e9 de n\u00e9gociation compos\u00e9e de techniciens en audiovisuel et de gr\u00e9eurs travaillant r\u00e9guli\u00e8rement au Sheraton Centre de Toronto convenait \u00e0 la n\u00e9gociation collective. Dans une d\u00e9cision dat\u00e9e du 8 janvier 2018, la Commission a ordonn\u00e9 aux parties de fournir des renseignements suppl\u00e9mentaires sur les heures travaill\u00e9es par les employ\u00e9s demeurant en litige au Centre Sheraton au cours des six mois pr\u00e9c\u00e9dant le d\u00e9p\u00f4t de la demande.<\/p><p>Le syndicat a soumis un organigramme indiquant 7 employ\u00e9s travaillant plus de 65% de leurs heures au Centre Sheraton, 7 employ\u00e9s travaillant entre 35 et 65% de leurs heures au Centre Sheraton, et 57 employ\u00e9s travaillant moins de 35% du temps au Centre Sheraton. L'employeur a accept\u00e9 cette information, mais a n\u00e9anmoins maintenu que le crit\u00e8re appropri\u00e9 devrait \u00eatre une relation d'emploi continue avec l'employeur et que le nombre d'heures ne devrait pas \u00eatre pertinent. La Commission a rejet\u00e9 cet argument au motif qu\u2019elle ne tenait pas compte du libell\u00e9 de la description de l\u2019unit\u00e9 de n\u00e9gociation qui utilise l\u2019expression \u00ab r\u00e9guli\u00e8rement employ\u00e9 \u00bb. Le groupe les plus nombreux est celui compos\u00e9 d'individus qui travaillent moins de 35% au Centre Sharaton et la Commission a ordonn\u00e9 aux parties de s\u2019occuper d\u2019abord de ce groupe et de d\u00e9poser des observations sur les raisons pour lesquelles ces individus devraient \u00eatre compris dans l\u2019unit\u00e9 de n\u00e9gociation.
