La requ\u00e9rante faisant l\u2019objet de la sentence arbitrale avait travaill\u00e9 pendant plusieurs ann\u00e9es en tant que cr\u00e9atrice de costumes pour la production de l'employeur \u00ab Supernatural 5 Films Inc. \u00bb La requ\u00e9rante a \u00e9t\u00e9 cong\u00e9di\u00e9e par l'employeur suite \u00e0 plusieurs all\u00e9gations de harc\u00e8lement \u00e0 l\u2019\u00e9gard de son comportement au travail. L'arbitre a conclu qu\u2019il ne s\u2019agissait que de motifs valables pour des mesures disciplinaires, mais que le licenciement de toute production future de l'employeur \u00e9tait excessive et a ordonn\u00e9 la r\u00e9int\u00e9gration de la requ\u00e9rante dans un milieu de travail autre que la production de Supernatural 5. L'arbitre a laiss\u00e9 aux parties le soin de d\u00e9terminer les conditions de r\u00e9int\u00e9gration de la requ\u00e9rante et a affirm\u00e9 qu'il demeurait saisi de toute question \u00e0 l'\u00e9gard de la r\u00e9int\u00e9gration de la requ\u00e9rante, dans l\u2019hypoth\u00e8se o\u00f9 les parties ne seraient pas en mesure de r\u00e9soudre les conditions entres elles.<\/p><p>Dans sa requ\u00eate \u00e0 la Commission des relations de travail de la Colombie-Britannique, le syndicat a fait valoir que l\u2019arbitre, dans sa sentence arbitrale, n'a pas offert d\u2019analyse motiv\u00e9e, n'a pas fourni d\u2019alternative \u00e0 la sanction pr\u00e9vue et n\u2019a pas non plus fourni de r\u00e9paration sp\u00e9cifique. La Commission a conclu que la requ\u00eate \u00e9tait pr\u00e9matur\u00e9e puisque la d\u00e9cision de l'arbitre n'\u00e9tait pas d\u00e9finitive; cela laissait ouvert la possibilit\u00e9 que l\u2019arbitre puisse rendre une d\u00e9cision relative aux conditions de la r\u00e9int\u00e9gration, si n\u00e9cessaire. La Commission a alors conclu qu\u2019elle n\u2019avait pas la comp\u00e9tence de proc\u00e9der \u00e0 un examen des sentences arbitrales jusqu'\u00e0 ce qu'une sentence arbitrale finale soit rendue, sauf si la question concernait la comp\u00e9tence de l\u2019arbitre ou que l'une des parties s'\u00e9tait vue refuser une audience \u00e9quitable.
