Le travailleur \u00e9tait employ\u00e9 comme constructeur de sc\u00e8ne (la plupart du temps en tant que charpentier) dans l'industrie du film et de la t\u00e9l\u00e9vision pendant 20 ans. Sur une p\u00e9riode de 5 ans, le travailleur a d\u00e9velopp\u00e9 des probl\u00e8mes respiratoires et a finalement \u00e9t\u00e9 diagnostiqu\u00e9 avec la scl\u00e9rodermie.<\/p><p>Dans le cadre de son emploi, le travailleur a \u00e9t\u00e9 expos\u00e9 \u00e0 plusieurs  polluants atmosph\u00e9riques, notamment la poussi\u00e8re de silice cristalline. Le Tribunal a conclu que le travailleur avait \u00e9t\u00e9 expos\u00e9 \u00e0 la poussi\u00e8re de silice en quantit\u00e9s variables au cours de son emploi de constructeur de sc\u00e8ne.<\/p><p>En premier lieu, il s\u2019agissait de d\u00e9terminer si l'exposition \u00e0 la poussi\u00e8re de silice pouvait causer la scl\u00e9rodermie. En s\u2019appuyant sur le t\u00e9moignage de cinq m\u00e9decins, le Tribunal a conclu qu'il existait un lien entre l'exposition \u00e0 la poussi\u00e8re de silice et la scl\u00e9rodermie.\u00a0<\/p><p>En deuxi\u00e8me lieu, il s\u2019agissait de savoir s\u2019il existait un seuil d\u2019exposition pour d\u00e9terminer si la scl\u00e9rodermie \u00e9tait due \u00e0 l'exposition \u00e0 la poussi\u00e8re de silice. Le Tribunal a statu\u00e9 que, jusqu'\u00e0 pr\u00e9sent, le niveau d'exposition n\u00e9cessaire pour l\u2019\u00e9tablissement d\u2019un lien de causalit\u00e9 d\u00e9finitif entre l\u2019exposition \u00e0 la poussi\u00e8re de silice et le d\u00e9veloppement de la scl\u00e9rodermie n\u2019avait pas encore \u00e9t\u00e9 \u00e9tablis dans le domaine m\u00e9dical ou scientifique. Cependant, le Tribunal a conclu que l'exposition \u00e0 des quantit\u00e9s de poussi\u00e8re de silice qui seraient autrement insignifiante, pouvait \u00eatre importante si l\u2019exposition \u00e9tait r\u00e9guli\u00e8re et de longue dur\u00e9e.<\/p><p>En troisi\u00e8me lieu, il s\u2019agissait de d\u00e9terminer si le travailleur avait \u00e9t\u00e9 expos\u00e9 \u00e0 suffisamment de poussi\u00e8re de silice pour \u00e9tablir un lien de causalit\u00e9 entre l'exposition et le d\u00e9veloppement de la scl\u00e9rodermie. Le Tribunal a conclu que le travailleur avait \u00e9t\u00e9 expos\u00e9 \u00e0 une \u00ab quantit\u00e9 importante de poussi\u00e8re de silice presque quotidiennement pendant une p\u00e9riode de 15 ans ou plus \u00bb.<\/p><p>Sur la base de ce qui pr\u00e9c\u00e8de, le Tribunal a conclu que l'exposition du travailleur \u00e0 la poussi\u00e8re de silice \u00e9tait \u00ab une cause importante du d\u00e9veloppement de la scl\u00e9rodermie \u00bb. En outre, le Tribunal a conclu que \u00ab la scl\u00e9rodermie du travailleur \u00e9tait une maladie professionnelle due \u00e0 son emploi \u00bb.
