Dans une sentence arbitrale rendue le 7 mai 2015 sans motifs, l\u2019arbitre Bernard Lefebvre a enjoint le syndicat de cesser de ne pas respecter le code vestimentaire \u00e9tabli par l\u2019employeur comme moyen de pression dans le contexte des n\u00e9gociations collectives. Dans la pr\u00e9sente, l\u2019arbitre a \u00e9nonc\u00e9 les motifs de sa d\u00e9cision arbitrale du 7 mai.<\/p><p>Le 27 avril 2015, le syndicat a avis\u00e9 l\u2019employeur que des moyens de pression seront entrepris d\u00e8s le lendemain dans les cin\u00e9mas Colossus de Laval et Cin\u00e9plex Ste-Foy. Le syndicat \u00e9tait de l\u2019avis que la prise de position de l\u2019employer sugg\u00e9rait que celui-ci avait choisi \u00ab un \u2018long\u2019 arbitrage \u00bb et que plusieurs des clauses litigieuses aurait d\u00fb faire  l\u2019objet des n\u00e9gociations d\u2019une entente depuis longtemps. Les moyens de pression exerc\u00e9s par les salari\u00e9s concernant la tenue vestimentaire comprenaient ne pas porter le porte-nom, porter le chandail \u00e0 l\u2019ext\u00e9rieur du pantalon, ne pas porter la casquette, et porter la casquette \u00e0 l\u2019envers.<\/p><p class=\" translation-block\">L\u2019employeur consid\u00e9rait ces tactiques ill\u00e9gales dans la mesure o\u00f9 ils constituent un changement dans des conditions contraires au Code du travail du Qu\u00e9bec (le \u00ab Code \u00bb). L\u2019article 59 du Code interdit aux employeurs de modifier les conditions de travail de ses salari\u00e9s pendant la p\u00e9riode de n\u00e9gociations collectives.  L\u2019article 60 pr\u00e9voit que cette p\u00e9riode, \u00ab il est interdit de conseiller ou d'enjoindre \u00e0 des salari\u00e9s de ne pas continuer \u00e0 fournir leurs services \u00e0 leur employeur aux m\u00eames conditions de travail. \u00bb<\/p><p>L\u2019employeur a demand\u00e9 \u00e0 l\u2019arbitre d\u2019ordonner au syndicat et ses membres de respecter le code vestimentaire. Le syndicat s\u2019opposait \u00e0 la demande de l\u2019employeur tout en reconnaissant que le code vestimentaire est une condition de travail. Le syndicat a soutenu que le Code ne conf\u00e8re pas \u00e0 l\u2019arbitre de diff\u00e9rend le pouvoir et la comp\u00e9tence d\u2019\u00e9mettre les ordonnances demand\u00e9es par l\u2019employeur. Subsidiairement, le syndicat a soutenu que l\u2019arbitre ne devrait pas d\u2019\u00e9mettre les ordonnances demand\u00e9es par l\u2019employeur puisqu\u2019il n\u2019y avait aucune preuve des all\u00e9gu\u00e9, ni preuve d\u2019urgence ou de pr\u00e9judice irr\u00e9parable.<\/p><p class=\" translation-block\">Le Code fait une distinction entre l\u2019arbitrage to diff\u00e9rend et l\u2019arbitrage de griefs. L\u2019arbitre a conclu que d\u00e9terminer si les articles 59 et 60 ont \u00e9t\u00e9 viol\u00e9s n\u2019est pas un \u00ab diff\u00e9rend \u00bb aux fins d\u2019arbitrage de diff\u00e9rend et que l\u2019employeur n\u2019a pas produit la preuve des all\u00e9gu\u00e9s. Cependant, \u00ab l\u2019arbitre commettrait un d\u00e9ni de justice s\u2019il refusait de d\u00e9cider sous pr\u00e9texte de l\u2019absence de preuve \u00bb (para. 37).<\/p><p class=\" translation-block\">De plus, l\u2019arbitre de diff\u00e9rend peut interpr\u00e9ter et appliquer les articles du Code aff\u00e9rentes \u00e0 l\u2019arbitrage d\u2019une premi\u00e8re convention collective pour d\u00e9cider s'il a comp\u00e9tence pour trancher une question en vertu du Code. L\u2019arbitre a conclu que le Code accordait aux arbitres de diff\u00e9rend la comp\u00e9tence suivante : \u00ab En tout temps avant sa sentence finale, un arbitre peut rendre toute d\u00e9cision int\u00e9rimaire qu'il croit juste et utile \u00bb (Code, art. 91) et de \u00ab rendre toute autre d\u00e9cision, y compris une ordonnance provisoire, propre \u00e0 sauvegarder les droits des parties \u00bb (Code, art. 100.12) et, ainsi, que le Code conf\u00e8re \u00e0 l\u2019arbitre de diff\u00e9rend d\u2019une premi\u00e8re convention collective le pouvoir d\u2019\u00e9mettre des ordonnances de sauvegarde au regard du maintien des conditions de travail, dans le cours de l\u2019arbitrage de diff\u00e9rend.<\/p><p>Les moyens de pression exerc\u00e9s par les salari\u00e9s concernant la tenue vestimentaire \u00ab sont des faits qui cr\u00e9ent une apparence de modifications des conditions de travail \u00bb (para. 65).
