La Cour supr\u00eame a conclu que les gains de s\u00e9curit\u00e9 pr\u00e9vus et associ\u00e9s \u00e0 la politique de l\u2019employeur \u00e9taient  \u00ab minimes, au mieux \u00bb, tandis que l\u2019atteinte \u00e0 la vie priv\u00e9e des employ\u00e9s \u00e9tait grave. La Cour supr\u00eame a expliqu\u00e9 que l\u2019employeur ne peut imposer une r\u00e8gle emportant des sanctions disciplinaires que si la n\u00e9cessit\u00e9 d\u2019adopter une telle r\u00e8gle l\u2019emporte sur les effets pr\u00e9judiciables de cette derni\u00e8re sur les droits \u00e0 la vie priv\u00e9e des employ\u00e9s.
