Le syndicat a argument\u00e9 que le licenciement \u00e9tait sans raison valable et qu'il constituait une discrimination raciale contraire au Code des droits de la personne. Le plaignant, qui travaillait dans la section des costumes, est noir. Le r\u00e9clamant qui l'a accus\u00e9 de harc\u00e8lement est blanc et travaillait comme figurant.<\/p><p>Le r\u00e9clamant s'est plaint du plaignant alors que tous deux travaillaient sur le plateau de La Reine (Reign), une production t\u00e9l\u00e9vis\u00e9e. Conform\u00e9ment \u00e0 sa politique sur le harc\u00e8lement, l'employeur a eu recours aux services d'une investigatrice en milieu de travail, Gillian Shearer. Elle a conclu, apr\u00e8s son enqu\u00eate, que les all\u00e9gations du r\u00e9clamant \u00e9taient en effet fond\u00e9es. L'employeur a pris en compte les conclusions de Shearer et a licenci\u00e9 le plaignant.<\/p><p>Apr\u00e8s avoir \u00e9cout\u00e9 des t\u00e9moignages de plusieurs t\u00e9moins, l'arbitre a d\u00e9termin\u00e9 que les all\u00e9gations de harc\u00e8lement \u00e9taient fond\u00e9es. L'arbitre n'a pas trouv\u00e9 le plaignant cr\u00e9dible et a privil\u00e9gi\u00e9 les t\u00e9moignages d'autres personnes qui contredisaient les dires du plaignant. L'arbitre a not\u00e9, entre autres, que le plaignant s'\u00e9tait confront\u00e9 avec col\u00e8re avec d'autres employ\u00e9s, avait envahi leur espace personnel, les avait regard\u00e9s de fa\u00e7on mena\u00e7ante, \u00e9vit\u00e9s, ignor\u00e9s et insult\u00e9s. Ces actions constituent du harc\u00e8lement en milieu de travail. L'arbitre n'a trouv\u00e9 aucune preuve que le plaignant avait re\u00e7u un traitement diff\u00e9rent bas\u00e9 sur sa race et a donc rejet\u00e9 l'all\u00e9gation de discrimination.<\/p><p class=\" translation-block\">Au cours de la proc\u00e9dure visant \u00e0 d\u00e9terminer si la p\u00e9nalit\u00e9 \u00e9tait appropri\u00e9e, l'arbitre a pris en compte : les obligations de l'employeur en vertu du projet de loi 168 visant \u00e0 modifier la Loi sur la sant\u00e9 et la s\u00e9curit\u00e9 au travail, les r\u00e9percussions sur le r\u00e9clamant, un employ\u00e9 plus jeune et qui a moins d'exp\u00e9rience dans l'industrie, qu'on a fait se sentir peu en s\u00e9curit\u00e9 sur son lieu de travail, l'absence de provocation de la part du r\u00e9clamant, l'absence de remords de la part du plaignant, et le fait que le licenciement n'a pas emp\u00each\u00e9 le plaignant de continuer \u00e0 travailler dans l'industrie mais l'a simplement emp\u00each\u00e9 de travailler sur les productions de l'employeur. Dans ces circonstances, l'arbitre a conclu que le licenciement \u00e9tait justifi\u00e9.<\/p><p>L'arbitre a affirm\u00e9 que sa d\u00e9cision de confirmer le licenciement sans laisser une derni\u00e8re chance au plaignant a \u00e9t\u00e9 influenc\u00e9 par un incident qui s'est produit pendant la proc\u00e9dure : apr\u00e8s que Gillian Shearer ait rendu son t\u00e9moignage et ait \u00e9t\u00e9 dispens\u00e9e de l'audience, le plaignant l'a suivie dehors, s'est approch\u00e9 d'elle par derri\u00e8re, a envahi son espace personnel et l'a affront\u00e9 avec col\u00e8re. Gillian Shearer est retourn\u00e9e \u00e0 l'audience et a produit cet incident en preuve.
