Parmi les recommandations figuraient des recommandations quant \u00e0 la r\u00e9partition de l\u2019anciennet\u00e9. Les parties ne s\u2019entendaient pas sur la mise en \u0153uvre de ces recommandations et, par cons\u00e9quent, un arbitre a \u00e9t\u00e9 nomm\u00e9 en qualit\u00e9 d\u2019IIC en vertu de la loi. L'arbitre a formul\u00e9 des lignes directrices pour les n\u00e9gociations et a d\u00e9clar\u00e9 que la question de r\u00e9partition d\u2019anciennet\u00e9 pouvait \u00eatre soumise \u00e0 l\u2019arbitre pour un processus d'arbitrage ex\u00e9cutoire. L\u2019IATSE 891 et l\u2019employeur sont parvenus \u00e0 un accord, cependant, les Teamsters n\u2019ont pas r\u00e9ussi \u00e0 s\u2019entendre sur un processus. L\u2019IATSE 891 a alors cherch\u00e9 \u00e0 retirer son offre. La question a alors \u00e9t\u00e9 soumise au processus d'arbitrage ex\u00e9cutoire.<\/p><p>Dans la sentence arbitrale sur la r\u00e9partition de l\u2019anciennet\u00e9, l\u2019arbitre a conclu que lors des n\u00e9gociations, l\u2019IATSE 891 ne pouvait pas retirer son offre initiale. Apr\u00e8s la publication de la sentence arbitrale, l\u2019employeur a \u00e9crit \u00e0 l'arbitre pour demander des \u00e9claircissements sur trois questions, notamment pour savoir si les licenciements devraient \u00eatre effectu\u00e9s dans le m\u00eame ordre que les appels, soit selon l\u2019anciennet\u00e9 du salari\u00e9. Apr\u00e8s avoir re\u00e7u la lettre de l\u2019employeur, l\u2019IATSE 891 a fait valoir que l'arbitre ne devrait pas se prononcer sur la question pos\u00e9e par l'employeur puisque que la question de l'ordre des licenciements n'\u00e9tait pas pos\u00e9e devant l'arbitre et, par cons\u00e9quent, l'arbitre n'avait pas la comp\u00e9tence pour se prononcer sur cette derni\u00e8re.<\/p><p>L\u2019arbitre a conclu que les r\u00e8gles qui s\u2019appliquent \u00e0 l\u2019ordre des appels s\u2019appliquent \u00e9galement \u00e0 l\u2019ordre des licenciements. L\u2019arbitre n\u2019a pas fourni des motivations \u00e0 l\u2019\u00e9gard de la contestation de sa comp\u00e9tence.<\/p><p>Dans son examen de la sentence arbitrale, la Commission des relations de travail de la Colombie-Britannique a conclu que la question de licenciement n\u2019est pas mentionn\u00e9e dans le mandat en vertu duquel l'arbitre avait \u00e9t\u00e9 nomm\u00e9 en qualit\u00e9 d\u2019IIC. Par cons\u00e9quent, les objections soulev\u00e9es par l\u2019IATSE 891 \u00ab ont soulev\u00e9 des questions graves de comp\u00e9tence qui exigent une r\u00e9ponse dans les motivations \u00e9crites de l'arbitre \u00bb. La Commission a conclu que l'arbitre n\u2019a pas rendu d\u2019analyse raisonn\u00e9e dans sa sentence.
