En guise de r\u00e9solution globale des questions soulev\u00e9es \u00e0 ce jour par le processus de l'article 41, la Commission a rendu les ordonnances et directives suivantes :<\/p><ol><li><ol><li>Le Film Council, l'UBCP et la DGC-BC \u00e9tabliront une association qui se r\u00e9unira r\u00e9guli\u00e8rement pour am\u00e9liorer la communication, la consultation et la coop\u00e9ration entre les trois syndicats et les producteurs en ce qui concerne les questions relatives \u00e0 l'industrie et aux relations de travail, et pour promouvoir et am\u00e9liorer la position concurrentielle de l'industrie cin\u00e9matographique de la Colombie-Britannique et l'\u00e9largissement des possibilit\u00e9s de travail au sein de cette industrie (sans faire double emploi avec le travail de la MPPIA et de la SAFER).  Le conseil sera disponible pour faciliter les r\u00e9unions, si n\u00e9cessaire.\u00a0 \u00a0<\/li><li>Lors des futurs cycles de n\u00e9gociations collectives entre les repr\u00e9sentants des producteurs (AMPTP et ACPFT) et le Film Council, l'UBCP et la DGC-BC, les exigences suivantes s'appliquent par pr\u00e9somption.  Les trois syndicats sont tenus de :<ul><li>Identifier les questions communes de n\u00e9gociation collective et coordonner les n\u00e9gociations relatives \u00e0 ces questions communes.<\/li><li>Se fournir mutuellement des mises \u00e0 jour g\u00e9n\u00e9rales sur l'avancement des n\u00e9gociations concernant les questions qui ne sont pas communes.<\/li><li>Se consulter lorsqu'une d\u00e9cision de proc\u00e9der \u00e0 un vote de gr\u00e8ve est une possibilit\u00e9 r\u00e9elle et avant que la d\u00e9cision finale de proc\u00e9der \u00e0 un vote de gr\u00e8ve ne soit prise.<\/li><li>Poursuivre la pratique des dates d'expiration communes pour les conventions collectives.<\/li><li>Poursuivre la pratique des arrangements \" safe harbor \" \u00e9tablis lors des cycles de n\u00e9gociation collective pr\u00e9c\u00e9dents, sous r\u00e9serve d'une demande opportune et r\u00e9ussie aupr\u00e8s de la Commission pour que la pr\u00e9somption en faveur de la poursuite de la pratique soit r\u00e9fut\u00e9e.<\/li><\/ul><\/li><li>Lorsqu'un accord de reconnaissance volontaire (ARV) valide est en place pour une production, aucune demande d'accr\u00e9ditation ne peut \u00eatre pr\u00e9sent\u00e9e pour le groupe d'employ\u00e9s vis\u00e9 par l'ARV.  S'il n'existe pas d'accord de reconnaissance volontaire, une demande d'accr\u00e9ditation peut \u00eatre pr\u00e9sent\u00e9e. Si la demande d'accr\u00e9ditation est accept\u00e9e, une convention collective, dont les conditions seront d\u00e9termin\u00e9es par la Commission, s'applique par pr\u00e9somption.  Les parties travailleront avec la Commission dans le cadre d'un processus consultatif afin d'\u00e9laborer le crit\u00e8re permettant de d\u00e9terminer si une LRVV est en place et les modalit\u00e9s de la convention collective pr\u00e9sum\u00e9e.<\/li><li>Un groupe de travail de l'industrie (le groupe de travail) compos\u00e9 de repr\u00e9sentants des parties et facilit\u00e9 par le Conseil sera mis sur pied pour explorer, \u00e9tudier et \u00e9laborer des recommandations pour des approches plus coop\u00e9ratives en mati\u00e8re de relations de travail dans l'industrie de la Colombie-Britannique.  \u00c0 cet \u00e9gard, le groupe de travail adoptera une approche fond\u00e9e sur les meilleures pratiques.
