L'employeur est un centre des congr\u00e8s et des arts qui fournit \u00e0 la fois des services d'\u00e9clairage et de son.<\/p><p class=\" translation-block\">Apr\u00e8s la retraite d'un technicien d'\u00e9clairage de sc\u00e8ne \u00e0 temps plein, l'employeur a affich\u00e9 un poste permanent de technicien en \u00e9clairage \u00e0 temps partiel. Le requ\u00e9rant a pos\u00e9 sa candidature pour le poste et l'a obtenu. En attribuant le poste, l'employeur a indiqu\u00e9 que le fonctionnaire s'estimant l\u00e9s\u00e9 serait responsable des t\u00e2ches du technicien en \u00e9clairage et en installations.<\/p><p>Le syndicat a soutenu que l'employeur avait viol\u00e9 la convention collective en convertissant un poste \u00e0 temps plein en poste \u00e0 temps partiel. Le syndicat a demand\u00e9 que le poste de technicien en \u00e9clairage de sc\u00e8ne indemnis\u00e9 soit affich\u00e9 conform\u00e9ment aux termes de la convention collective et que le requ\u00e9rant soit pour toute perte financi\u00e8re. L'employeur a ni\u00e9 avoir viol\u00e9 la convention collective et a fait valoir que les termes de la convention collective ne l'obligent pas \u00e0 afficher un poste \u00e0 plein temps. En outre, il avait d\u00e9termin\u00e9 qu'un technicien en \u00e9clairage \u00e0 plein temps n'\u00e9tait pas n\u00e9cessaire.<\/p><p>Le Conseil d'arbitrage a d\u00e9termin\u00e9 que l'employeur n'avait pas viol\u00e9 la convention collective lorsqu'il a affich\u00e9 le poste vacant comme poste \u00e0 temps partiel. Sans de disposition dans la convention collective limitant les droits de gestion, un employeur peut distribuer le travail comme il le d\u00e9sire. Dans ce cas, la convention collective n'exigeait pas que la poste soit affich\u00e9e \u00e0 temps plein et ni exiger de l'employeur qu'elle puisse combler le poste vacant.
