Shadbolt est devenu pr\u00e9sident du Syndicat en f\u00e9vrier 2014 et a \u00e9t\u00e9 temporairement suspendu de sa charge \u00e9lective en attendant l\u2019issue de ses plaintes le 6 f\u00e9vrier 2015. Il a \u00e9t\u00e9 inform\u00e9 par affidavit qu\u2019il a \u00e9t\u00e9 accus\u00e9 en vertu des articles 11.1 (Mise en accusation des dirigeants) et 12.1 (Discipline des membres) conform\u00e9ment aux Statuts et R\u00e8glements.<br \/><br \/>Kevin McCloy, un autre membre du syndicat, a accept\u00e9 d\u2019agir en tant que repr\u00e9sentant de Shadbolt au cours du proc\u00e8s. Finalement, McCloy est devenu incapable de le repr\u00e9senter  pour des raisons de sant\u00e9. Shadbolt a obtenu un ajournement du tribunal du Syndicat le 28 f\u00e9vrier 2015, reportant la date au 6 mars 2015.<br \/><br \/>En raison des d\u00e9lais serr\u00e9s, Shabolt a d\u00e9cid\u00e9 qu\u2019il aurait besoin d\u2019\u00eatre repr\u00e9sent\u00e9 juridiquement par un avocat. Shabolt a retenu les services d\u2019un avocat \u00e0 Banister &amp; Company le 4 mars 2015. Ce jour-l\u00e0, l\u2019avocat a averti le Tribunal par \u00e9crit du recrutement d\u2019un avocat.<br \/><br \/>Josef Chung a r\u00e9pondu pour le Tribunal. Selon Chung, seul un membre de l\u2019Alliance peut agir comme avocat conform\u00e9ment aux Statuts et R\u00e8glements du Syndicat. L\u2019avocat a r\u00e9pondu dans une lettre que l\u2019article 10 du Code du Travail prot\u00e9geait le droit de choisir son conseiller juridique. Un autre ajournement a \u00e9t\u00e9 demand\u00e9 jusqu\u2019\u00e0 ce que le Tribunal puisse adjudiquer la question. Chung a r\u00e9pondu le 5 mars 2015 que l\u2019ajournement n\u2019avait pas \u00e9t\u00e9 accord\u00e9 et que tous les recours internes avaient \u00e9t\u00e9 \u00e9puis\u00e9s. Le proc\u00e8s s\u2019est continu\u00e9 le 6 mars 2015.<br \/><br \/>La position de Shadbolt est qu\u2019il avait le droit de choisir son conseiller juridique. Il soumet qu\u2019on lui a refus\u00e9 son droit \u00e0 une justice naturelle lorsqu\u2019on lui a refus\u00e9 son avocat et un autre ajournement. Il demande une d\u00e9claration selon laquelle son droit \u00e0 une justice naturelle a \u00e9t\u00e9 viol\u00e9, que l\u2019article des Statuts et R\u00e8glements sont en infraction de l\u2019article 10 du Code, les co\u00fbts, et une d\u00e9claration selon laquelle le proc\u00e8s syndical n\u2019est pas valable.<br \/><br \/>Le Syndicat soumet que le plaignant doit \u00e9puiser les m\u00e9canismes d\u2019appel internes avant d\u2019avoir recours \u00e0 la Commission. Alternativement, si sa position est incorrecte, le Syndicat accepte de mettre de c\u00f4t\u00e9 la d\u00e9cision du Tribunal et de proc\u00e9der \u00e0 un nouveau proc\u00e8s. Le Syndicat fait valoir qu\u2019en raison de la position alternative, l\u2019instance en cours devient sans objet.<br \/><br \/><u>D\u00c9CISION<br \/><br \/><\/u>La Commission a soutenu que l\u2019instance devant le Tribunal repr\u00e9sentait une affaire disciplinaire grave pour laquelle il existe un droit \u00e0 un conseiller juridique. L\u2019Article 12.7 des Statuts et R\u00e8glements constitue une infraction aux droits de l\u2019article 10(1) en vertu du Code. La Commission a d\u00e9clar\u00e9 que la d\u00e9cision du Tribunal n\u2019\u00e9tait pas valable. La Commission a aussi d\u00e9clar\u00e9 que le seuil d\u2019infraction de justice naturelle  commise dans cette affaire ne justifiait pas les co\u00fbts.<br \/><br \/><u>ANALYSE<br \/><br \/><\/u>Conform\u00e9ment \u00e0 l\u2019article 10(1) du Code, toute personne a droit \u00e0 la justice naturelle dans le cadre de conflits li\u00e9s \u00e0 des questions relatives aux Statuts du Syndicat et aux mesures disciplinaires du Syndicat. Cette disposition  est directement li\u00e9e \u00e0 la mise en accusation et l\u2019expulsion potentielle de Shadbolt. En cons\u00e9quence, la Commission a d\u00e9clar\u00e9 qu\u2019elle avait l\u2019autorit\u00e9 pour d\u00e9cider de cette affaire.<br \/><br \/>La politique g\u00e9n\u00e9rale de la Commission est d\u2019encourager le d\u00e9veloppement de proc\u00e9dures internes pour la gestion de plaintes syndicales internes et afin d\u2019exiger que les employ\u00e9s \u00e9puisent les m\u00e9canismes internes avant que la Commission ne s\u2019occupe desdites plaintes. Cependant, la Commission a d\u00e9clar\u00e9 que dans les cas o\u00f9 le m\u00e9canisme interne \u00e0 disposition des employ\u00e9s s\u2019av\u00e9rait <strong>ne pas \u00eatre pratique, juste ou rentable, <\/strong>la Commission d\u00e9rogerait \u00e0 sa politique habituelle. Dans cette situation, la Commission a d\u00e9clar\u00e9 que le d\u00e9ni du droit \u00e0 un avocat par le Tribunal, assujetti \u00e0 des appels internes, repr\u00e9senterait un d\u00e9lai extraordinaire qui appartiendrait \u00e0 la cat\u00e9gorie des exceptions g\u00e9n\u00e9rales. La proc\u00e9dure d\u2019appel interne du Tribunal ne se conclurait pas avant le Congr\u00e8s du Syndicat international de juillet 2017 en vertu de l\u2019article 13.1 des R\u00e8glements. La Commission a d\u00e9clar\u00e9 que cela rendait les m\u00e9canismes internes <strong>non pratiques, injustes et non rentables.<\/strong>.<br \/><br \/><span style=\"font-size: 1.125rem;\">Le Syndicat a fait valoir qu\u2019il a propos\u00e9 d\u2019offrir un nouveau proc\u00e8s et donc que l\u2019affaire port\u00e9e devant la Commission \u00e9tait sans objet. Appliquant les principes de la <\/span><em style=\"font-size: 1.125rem;\">Health Employee\u2019s Association of British Columbia (Fraser Health Authority and Burnaby Hospital),<\/em><span style=\"font-size: 1.125rem;\"> la Commission a not\u00e9 que la pr\u00e9sente affaire pr\u00e9sentait une exigence de d\u00e9bat contradictoire, que la conclusion d\u2019un manque d\u2019int\u00e9r\u00eat ne conserverait pas les ressources et qu\u2019il s\u2019agissait d\u2019une question de nature r\u00e9currente devant le Syndicat. La violation de justice naturelle n\u2019est pas un \u00e9v\u00e8nement extraordinaire et d\u00e9coule directement d\u2019une disposition  des Statuts qui, selon les conclusions de la Commission, s\u2019appliquerait aux instances futures. \u00c0 la lumi\u00e8re de ces faits, la Commission a exerc\u00e9 son pouvoir de discr\u00e9tion pour instruire le bien-fond\u00e9 de l\u2019affaire.<br \/><br \/><\/span>L\u2019article 12.17 des Statuts et R\u00e8glements est clair sur le fait qu\u2019un membre de l\u2019Alliance en r\u00e8gle en tant qu\u2019avocat, ne peut \u00eatre conseiller juridique. La Commission a reformul\u00e9 les principes d\u2019abord articul\u00e9s dans <em>Marilyn Coleman BCLRB No. B282\/95 28 CLRBR, <\/em>qui s\u2019int\u00e9ressaient \u00e0 la nature de la justice naturelle dans le contexte de l\u2019article 10 du Code. Selon la Commission dans <em>Marilyn Coleman, <\/em>\"<strong>\u00ab \u00e0 l\u2019\u00e9gard de questions graves telles que la suspension, l\u2019expulsion ou la destitution, il existe un droit \u00e0 l\u2019assistance d\u2019un avocat \u00bb .<\/strong>La Commission a cit\u00e9 la Cour d\u2019appel de la Colombie-Britannique dans <em>Boe c. Hamilton (1988) BCLR (2d) 49, <\/em>d\u00e9clarant que<strong>\u00ab lorsque les cons\u00e9quences potentielles sont suffisamment graves, il existe un droit \u00e0 l\u2019assistance d\u2019un avocat \u00bb  .<\/strong>Les sanctions potentielles selon l\u2019article 11.13 des Statuts et R\u00e8glements incluent l\u2019expulsion, la suspension et\/ou l\u2019amende.
