Le grief portait sur une suspension impos\u00e9e par l'employeur, Oilers Entertainment Group Canada Corporation.<br \/><br \/>Un banc de la Commission des relations de travail de l'Alberta a sommairement rejet\u00e9 la plainte, estimant qu'elle n'avait aucune chance raisonnable de succ\u00e8s de proc\u00e9der \u00e0 l'audience.<br \/><br \/>Le plaignant avait soulev\u00e9 des pr\u00e9occupations au sujet d'un syst\u00e8me de s\u00e9curit\u00e9 critique sur le lieu de travail. Une v\u00e9rification ind\u00e9pendante a \u00e9t\u00e9 effectu\u00e9e et les questions de s\u00e9curit\u00e9 n'avaient pas \u00e9t\u00e9 trait\u00e9es. Les probl\u00e8mes ont \u00e9t\u00e9 signal\u00e9s aupr\u00e8s du d\u00e9partement de la Sant\u00e9 et s\u00e9curit\u00e9 au travail, et l'employeur a bl\u00e2m\u00e9 le plaignant. L'employeur a suspendu le plaignant et a envoy\u00e9 une lettre \u00e0 l'agent des affaires du syndicat pour l'aviser de la suspension. La lettre d\u00e9crivait le fonctionnaire comme \u00e9tant une \u00abdistraction\u00bb, un \u00abemp\u00eachement\u00bb et une \u00abg\u00eane \u00e0 l'image de la Place Rogers\u00bb.<br \/><br \/><span style=\"font-size: 1.125rem;\">Le plaignant a trouv\u00e9 la lettre diffamatoire et craignait que la lettre ait \u00e9t\u00e9 laiss\u00e9e \u00e0 la vue des membres du syndicat. Le Syndicat a d\u00e9pos\u00e9 un grief concernant la suspension du plaignant. L'employeur a fait deux offres pour r\u00e9gler le grief, la premi\u00e8re pour substituer la suspension \u00e0 un avertissement \u00e9crit, et la seconde pour lever la suspension et payer toute perte mon\u00e9taire pour compenser pour les deux \u00e9v\u00e9nements que le plaignant \u00e9tait incapable de travailler en raison de la suspension. Le plaignant n'\u00e9tait pas int\u00e9ress\u00e9 \u00e0 accepter une offre et a insist\u00e9 que l'employeur fournisse des excuses \u00e9crites et une lettre de r\u00e9tractation. Le syndicat a r\u00e9gl\u00e9 le grief, apr\u00e8s avoir conclu qu'il avait obtenu autant qu'il aurait pu le faire en arbitrage.<br \/><br \/><\/span>La Commission a d\u00e9termin\u00e9 que le syndicat n'avait pas manqu\u00e9 \u00e0 son devoir de repr\u00e9sentation \u00e9quitable. Il avait r\u00e9agi rapidement, enqu\u00eat\u00e9 sur la plainte, d\u00e9pos\u00e9 un grief et n\u00e9goci\u00e9 un r\u00e8glement raisonnable avec l'employeur.
