Bien que Mme Bernard a choisi de ne pas \u00eatre membre de l\u2019IPFPC, elle b\u00e9n\u00e9ficie des avantages de la convention collective, a droit \u00e0 la repr\u00e9sentation du syndicat et est tenue de verser les cotisations syndicales.\u00a0<\/p><p class=\" translation-block\">Mme Bernard a contest\u00e9 une ordonnance de la Commission des relations de travail dans la fonction public (la \u00ab Commission \u00bb) de 2008 permettant l\u2019employeur de fournir au syndicat les coordonn\u00e9s r\u00e9sidentielles des employ\u00e9e au motif que ceci porte atteinte \u00e0 son droit \u00e0 la vie priv\u00e9e. Mme Bernard a pr\u00e9sent\u00e9 une demande de contr\u00f4le judiciaire de la d\u00e9cision de la Commission aupr\u00e8s de la Cour d\u2019appel f\u00e9d\u00e9rale (\u00ab CAF \u00bb). La CAF a conclu que la Commission aurait d\u00fb examiner l\u2019application de la Loi sur la protection des renseignements personnels \u00e0 la communication des coordonn\u00e9es r\u00e9sidentielles et a renvoy\u00e9 l\u2019affaire \u00e0 la Commission. Mme Bernard et le Commissariat \u00e0 la protection de la vie priv\u00e9e sont intervenus \u00e0 l\u2019audience.<\/p><p>Dans le cadre de l\u2019audience en r\u00e9examen, Mme Bernard a fait des arguments additionnels fond\u00e9s sur la Charte. Elle a fait valoir que la communication de ses coordonn\u00e9es r\u00e9sidentielles portait atteinte \u00e0 la libert\u00e9 de ne pas s\u2019associer au syndicat prot\u00e9g\u00e9 par l\u2019article 2(d) de la Charte ainsi qu\u2019\u00e0 son droit \u00e0 la protection contre les fouilles, les perquisitions et les saisies abusives prot\u00e9g\u00e9 par l\u2019article 8 de la Charte. La Commission a fait ressortir de l\u2019ordonnance initiale des caract\u00e9ristiques destin\u00e9es \u00e0 accro\u00eetre le respect de la vie priv\u00e9e mais ne s\u2019est pas pench\u00e9e sur les arguments de Mme Bernard fond\u00e9s sur la Charte.<\/p><p>Mme Bernard a pr\u00e9sent\u00e9 une nouvelle demande de contr\u00f4le judiciaire. La CAF a alors conclu que la Commission avait rendu une d\u00e9cision raisonnable et a rejet\u00e9 l\u2019appel. Mme Bernard a demand\u00e9 l\u2019autorisation d\u2019interjeter appel de l\u2019arr\u00eat de la CAF aupr\u00e8s de la Cour Supr\u00eame du Canada.\u00a0<\/p><p>La Cour Supr\u00eame du Canada a rejet\u00e9 l\u2019appel de Mme Bernard. Il y avait une dissidence en partie sur la question tr\u00e8s pr\u00e9cise de savoir s\u2019il \u00e9tait raisonnable pour la Commission de ne pas examiner les arguments de Mme Bernard fond\u00e9s sur la Charte. En fin de compte, cependant, la Cour a conclu \u00e0 l\u2019unanimit\u00e9 que la communication des coordonn\u00e9es r\u00e9sidentielles par l\u2019employeur ne porte pas atteinte \u00e0 la libert\u00e9 de Mme Bernard de ne pas s\u2019associer au syndicat et que l'art. 8 de la Charte ne s\u2019appliquait pas en l\u2019esp\u00e8ce.<\/p><p><strong>Droits \u00e0 la vie priv\u00e9e<\/strong><\/p><p>La Cour a conclu que la communication des coordonn\u00e9es r\u00e9sidentielles par l\u2019employeur au syndicat ne porte pas atteinte au droit de Mme Bernard \u00e0 la vie priv\u00e9e puisqu\u2019il s\u2019agit d\u2019un usage compatible avec les fins auxquelles le gouvernement employeur recueillait ces renseignements.  Cet usage compatible s\u2019inscrit dans les param\u00e8tres de ce que permet la Loi sur la protection des renseignements personnels.  La Cour a conclu que l\u2019agent n\u00e9gociateur, en tant que repr\u00e9sentant exclusif de tous les membres de l\u2019unit\u00e9 de n\u00e9gociation\u2014m\u00eame les employ\u00e9s assujettis \u00e0 la formule Rand\u2014a besoin de ces renseignements pour s\u2019acquitter de ses obligations de repr\u00e9sentation conform\u00e9ment \u00e0 la Loi sur les relations de travail dans la fonction publique. De plus, le syndicat ne pouvait pas compter sur les communications effectu\u00e9es au travail pour s\u2019acquitter de ses obligations de repr\u00e9sentation.\u00a0<\/p><p>Finalement, sur la question du droit \u00e0 la vie priv\u00e9e, la Cour a fait observer que l\u2019employeur devait communiquer les renseignements essentiels pour permettre au syndicat de s\u2019acquitter de ses obligations de repr\u00e9sentation afin que l\u2019employeur et le syndicat soient sur un pied d\u2019\u00e9galit\u00e9 quant aux renseignements relatifs \u00e0 la relation de n\u00e9gociation collective.<\/p><p><strong>Libert\u00e9 d\u2019association<\/strong><\/p><p>La Cour a rejet\u00e9 l\u2019argument soulev\u00e9 par Mme Bernard relativement \u00e0 la libert\u00e9 d\u2019association, indiquant que l\u2019argument \u00ab n\u2019a aucune assise juridique. \u00bb  La Cour a confirm\u00e9 son raisonnement dans la d\u00e9cision historique dans l\u2019arr\u00eat Lavigne, selon laquelle l\u2019article 2(d) \u00ab ne prot\u00e8ge pas contre toute forme d\u2019association involontaire et n\u2019a pas \u00e9t\u00e9 con\u00e7u pour contrer l\u2019association avec autrui qui est une composante n\u00e9cessaire et in\u00e9vitable de l\u2019appartenance \u00e0 une soci\u00e9t\u00e9 d\u00e9mocratique moderne. \u00bb<\/p><p><strong>Protection contre les fouilles, les perquisitions et les saisies abusives<\/strong><\/p><p>La Cour a rejet\u00e9 l\u2019argument soulev\u00e9 par Mme Bernard que les actions de l\u2019employeur portent atteintes \u00e0 son droit \u00e0 la protection contre les fouilles, les perquisitions et les saisies abusives prot\u00e9g\u00e9 par l\u2019article 8 de la Charte.
