Pendant les 40 minutes de la panne de courant, l'employeur a demand\u00e9 aux employ\u00e9s de rester dans le b\u00e2timent, en \" attente \", pendant que l'employeur examinait le probl\u00e8me. Le syndicat a fait valoir que les employ\u00e9s concern\u00e9s avaient le droit d'\u00eatre pay\u00e9s pour le temps travaill\u00e9 au-del\u00e0 des trois heures et demie d'appel r\u00e9sultant de la panne de courant (arrondi \u00e0 l'heure suivante conform\u00e9ment \u00e0 la convention collective). L'employeur a fait valoir qu'aucun travail n'a \u00e9t\u00e9 effectu\u00e9 pendant la panne de courant de 40 minutes et que les employ\u00e9s ne devraient donc pas \u00eatre pay\u00e9s pour cette p\u00e9riode. L'employeur a \u00e9galement fait valoir que les 40 minutes de travail effectu\u00e9es au-del\u00e0 de la fin de l'appel de service normal de 3,5 heures n'\u00e9taient qu'un accomplissement de l'obligation de l'appel de service normal de 3,5 heures de chaque employ\u00e9, qui a \u00e9t\u00e9 raccourci de 40 minutes en raison de la panne de courant. L'arbitre McDowell a conclu que le temps que les employ\u00e9s sont rest\u00e9s au travail pendant la panne d'\u00e9lectricit\u00e9 \u00e9tait du \"travail\" et qu'ils avaient le droit d'\u00eatre pay\u00e9s pour le temps travaill\u00e9 au-del\u00e0 de l'appel de rendement normal de 3,5 heures.
