Le requ\u00e9rant a \u00e9t\u00e9 licenci\u00e9 \u00e0 la suite d'un incident dit culminant, apr\u00e8s un certain nombre d'incidents qualifi\u00e9s par l'employeur d'insubordination ou de conduite inappropri\u00e9e.  L'incident culminant s'est produit le 11 octobre 2011 lorsque la requ\u00e9rante aurait assist\u00e9 \u00e0 une r\u00e9union du personnel, aurait cri\u00e9 apr\u00e8s l'employeur et aurait quitt\u00e9 les lieux.  Bien qu'elle soit revenue pour terminer son travail lors de la repr\u00e9sentation du soir, l'employeur all\u00e8gue qu'elle a refus\u00e9 de fournir \u00e0 l'employeur le mot de passe de son ordinateur de travail.  \u00c0 la suite de l'incident, la requ\u00e9rante a \u00e9t\u00e9 imm\u00e9diatement suspendue avec salaire, puis licenci\u00e9e.<\/p><p>L'IATSE a d\u00e9pos\u00e9 un grief contre le licenciement pour deux motifs.  Premi\u00e8rement, l'IATSE a fait valoir que le licenciement constituait une deuxi\u00e8me mesure disciplinaire pour le m\u00eame incident et deuxi\u00e8mement, l'IATSE a fait valoir que l'employeur n'avait pas de motif valable pour licencier la requ\u00e9rante.<\/p><p>En ce qui concerne l'argument de la \"double condamnation\", l'arbitre a estim\u00e9 que le licenciement ne constituait pas une deuxi\u00e8me mesure disciplinaire.  L'arbitre a estim\u00e9 que la suspension s'apparentait \u00e0 une \"suspension en attendant une enqu\u00eate\".  Il a d\u00e9clar\u00e9 que l'employeur n'avait pas pris la d\u00e9cision finale de licencier le requ\u00e9rant avant la tenue d'une r\u00e9union au cours de laquelle le requ\u00e9rant avait eu l'occasion de fournir une r\u00e9ponse.<\/p><p>L'arbitre a conclu que l'employeur avait un motif valable pour la discipline, mais que le licenciement \u00e9tait excessif.  Il a donc remplac\u00e9 le licenciement par une suspension de 21 jours.  Ce faisant, l'arbitre a conclu que la requ\u00e9rante n'avait pas refus\u00e9 intentionnellement de fournir le mot de passe de son ordinateur de travail, ce qui, selon l'arbitre, \u00e9tait un facteur cl\u00e9 dans la d\u00e9cision de l'employeur de la licencier.  De plus, l'arbitre a d\u00e9clar\u00e9 que pour pouvoir invoquer un dossier d'emploi ant\u00e9rieur \u00e0 la convention collective, l'employeur doit prouver les \u00e9v\u00e9nements ant\u00e9rieurs all\u00e9gu\u00e9s.  Toutefois, l'arbitre a jug\u00e9 que le comportement du requ\u00e9rant lors de la r\u00e9union, le fait qu'il ait quitt\u00e9 le lieu de travail et qu'il n'y soit revenu qu'\u00e0 certaines conditions, constituait un cas grave d'insubordination.
