La section locale a accr\u00e9dit\u00e9 un groupe d'employ\u00e9s d'avant-sc\u00e8ne et a ensuite \" \u00e9chang\u00e9 \" ce groupe en \u00e9change de la reconnaissance volontaire d'un groupe d'employ\u00e9s techniques.  Le Th\u00e9\u00e2tre a ensuite demand\u00e9 diverses d\u00e9cisions sur la validit\u00e9 de la convention collective pour le groupe d'employ\u00e9s techniques.  En particulier, le Th\u00e9\u00e2tre a soutenu que (i) la convention \u00e9tait sans effet parce que son n\u00e9gociateur n'avait pas l'autorit\u00e9 r\u00e9elle ou apparente de conclure la convention ; (ii) que le Th\u00e9\u00e2tre n'\u00e9tait pas le v\u00e9ritable employeur des employ\u00e9s techniques ; et (iii) que la convention collective concernant le groupe d'employ\u00e9s techniques \u00e9tait invalide parce que l'\"\u00e9change\" constituait une violation du devoir de repr\u00e9sentation \u00e9quitable de la section locale.
