Le syndicat avait d\u00e9pos\u00e9 un grief au nom de Bill Higgins all\u00e9guant que l'employeur avait enfreint aux usages.<\/p><p>Le syndicat a fait valoir que les travailleurs qui travaillent plus de 5 heures avaient droit \u00e0:<\/p><ul><li style=\"list-style-type: none\"><ul><li>un bonus de 3,50 $ de l'heure<\/li><li>une heure de paie suppl\u00e9mentaire<\/li><li>un repas avec une bonne pause-repas<\/li><li>un bon repas<\/li><\/ul><\/li><\/ul><p>Le syndicat a pr\u00e9sent\u00e9 des preuves des usages qui indiquaient que l'employeur fournissait de tels articles depuis de nombreuses ann\u00e9es et avait modifi\u00e9 sa pratique durant l'\u00e9t\u00e9 2018. L'employeur a soutenu avoir discut\u00e9 des changements \u00e0 l'article 14 avec le syndicat et modifi\u00e9 le libell\u00e9 en cons\u00e9quence.<\/p><p>L'arbitre s'est concentr\u00e9 sur le libell\u00e9 de l'article 14 et a conclu qu'il porte \u00e0 la confusion et est vague. N\u00e9anmoins, l'arbitre a rejet\u00e9 le grief parce que la preuve des usages \u00e9tait insuffisante pour \u00e9tayer l'argument de l'usage du syndicat. L'arbitre \u00e9tait limit\u00e9 \u00e0 examiner les termes de la convention collective.<\/p><p>L'arbitre s'est concentr\u00e9 sur le libell\u00e9 de l'article 14 et a conclu qu'il porte \u00e0 la confusion et est vague. N\u00e9anmoins, l'arbitre a rejet\u00e9 le grief parce que la preuve des usages \u00e9tait insuffisante pour \u00e9tayer l'argument de l'usage du syndicat. L'arbitre \u00e9tait limit\u00e9 \u00e0 examiner les termes de la convention collective.<\/p><table><tbody><tr><td width=\"319\"><p>Article<\/p><\/td><td width=\"319\"><p>Interpr\u00e9tation<\/p><\/td><\/tr><tr><td width=\"319\"><p>14.03:<br \/>Il n'est permis de travailler plus de cinq (5) heures sans pause-repas qu'en cas de n\u00e9cessit\u00e9 absolue et avec la permission de l'agent d'affaires de l'I.A.T.S.E., section locale 906A, sauf dans les cas pr\u00e9vus aux articles 14.05 et 14.06.<\/p><\/td><td width=\"319\"><p>Habituellement, un travailleur aura une pause-repas apr\u00e8s 5 heures, mais cette r\u00e8gle peut \u00eatre modifi\u00e9e si cela est absolument n\u00e9cessaire si elle est approuv\u00e9e, sous r\u00e9serve des articles 14.05 et 14.06<\/p><p>-sauf pour 14.05 et 14.06<\/p><\/td><\/tr><tr><td width=\"319\"><p>14.04:<br \/>Sous r\u00e9serve des dispositions des paragraphes 14.05, 14.06 et 14.07, si le nombre d'heures de travail cons\u00e9cutives d\u00e9passe cinq (5), conform\u00e9ment au paragraphe 14.03, il y aura une prime d'une heure de salaire suppl\u00e9mentaire au taux normal et un repas appropri\u00e9 sera fourni \u00e0 chaque personne et pay\u00e9 par la direction. Une demi-heure sera accord\u00e9e aux employ\u00e9s pour prendre ce repas.<\/p><\/td><td width=\"319\"><p>Si un travailleur travaille plus de 5 heures cons\u00e9cutives, le travailleur re\u00e7oit une prime et un bon repas, et une demi-heure pour le manger, sous r\u00e9serve des articles 14.05, 14.06 et 14.07<\/p><p>-sauf pour 14.05, 14.06 et 14.07<\/p><\/td><\/tr><tr><td width=\"319\"><p>14.05<br \/>L'article 14.03 ne s'applique pas lorsqu'il s'agit d'un appel de spectacle sp\u00e9cifique ou d'une combinaison de spectacle et de rel\u00e8ve ; tout temps au-del\u00e0 de cinq (5) heures sera pay\u00e9 au taux en vigueur plus une prime de $3,50 par heure.<\/p><\/td><td width=\"319\"><p>D\u00e9crit les avantages de travailler sur un \"show call\" ou une combinaison de show et transition (bonus de 3,50 $ par heure sur 5 heures), mais ne dit rien sur les repas<\/p><\/td><\/tr><tr><td width=\"319\"><p>14.06<br \/>L'article 14.03 ne s'applique pas lorsque, les jours o\u00f9 deux repr\u00e9sentations sont pr\u00e9vues et qu'il est impossible pour le personnel concern\u00e9 de b\u00e9n\u00e9ficier d'une pause-repas compl\u00e8te d'une heure, une prime d'une heure suppl\u00e9mentaire de salaire au taux normal et un repas appropri\u00e9 seront fournis \u00e0 chaque personne aux frais de la direction.
