L'employeur a soutenu que le crit\u00e8re \u00e0 appliquer pour d\u00e9terminer le statut de l'employ\u00e9e contest\u00e9e est de savoir si ses fonctions et responsabilit\u00e9s \u00e9taient telles que son inclusion dans l'unit\u00e9 de n\u00e9gociation donnerait lieu \u00e0 un conflit d'int\u00e9r\u00eats en mati\u00e8re de relations de travail.<\/p><p style=\"font-weight: 400\">La Commission a statu\u00e9 que l'employ\u00e9e contest\u00e9e \u00e9tait une employ\u00e9e au sens de la <em>Loi de 1995 sur les relations de travail<\/em>qu'elle n'\u00e9tait pas employ\u00e9e \u00e0 titre de contremaitre principal, n'occupait pas un poste au-dessus du rang de contremaitre adjoint, et n'\u00e9tait donc pas exclu de l'unit\u00e9 de n\u00e9gociation propos\u00e9e par le syndicat. En particulier, la Commission a constat\u00e9 que l'employ\u00e9e contest\u00e9e s'acquittait de certaines fonctions de gestion, notamment en recommandant les personnes qui devraient \u00eatre s\u00e9lectionn\u00e9es en tant que peintres sc\u00e9niques et en \u00e9valuant s'il s'agissait d'un d\u00e9butant, d'un interm\u00e9diaire ou d'un avanc\u00e9 aux fins de r\u00e9mun\u00e9ration. Cependant, le directeur de la production et le service des ressources humaines de l'employeur avaient le dernier mot si une personne devenait ou non un peintre sc\u00e9nique, et le niveau de salaire dont cette personne b\u00e9n\u00e9ficierait.
