La demanderesse avait d\u00e9pos\u00e9 une demande en vertu du Code des droits de la personne (le \u00ab Code \u00bb) concernant des all\u00e9gations de harc\u00e8lement sexuel, un manquement \u00e0 r\u00e9pondre correctement aux all\u00e9gations de harc\u00e8lement sexuel, un manquement \u00e0 s'adapter \u00e0 l'invalidit\u00e9 de la demanderesse en faisant respecter sa politique antitabagisme ainsi que des repr\u00e9sailles. La demanderesse a nomm\u00e9 plusieurs intim\u00e9s dont l'Alliance internationale des employ\u00e9s de la sc\u00e8ne (AIEST\/IATSE) section locale 461 et plusieurs de ses repr\u00e9sentants (les intim\u00e9s du syndicat), le Shaw Festival Foundation et un de ses repr\u00e9sentants (les intim\u00e9s de l'employeur) ainsi qu'un intim\u00e9 personnel, Domenic Marcone. Apr\u00e8s 15 jours d'audience, le TDPO a rendu une d\u00e9cision provisoire rejetant la demande contre les intim\u00e9s du syndicat et les intim\u00e9s de l'employeur bas\u00e9e sur le fait qu'il \u00e9tait tr\u00e8s peu probable qu'elles aboutissent. La d\u00e9cision provisoire n'a pas rejet\u00e9 la demande contre Marcone.<\/p><p>Dans sa demande de r\u00e9examen, la demanderesse a pr\u00e9sent\u00e9 quatre points \u00e0 prendre en compte :<\/p><ol><li style=\"list-style-type: none;\"><ol><li>Le TDPO a commis une erreur en n'appliquant pas le crit\u00e8re juridique \u00e9tabli concernant  l'obligation de l'employeur d'enqu\u00eater sur les plaintes de harc\u00e8lement sexuel d\u00e9pos\u00e9es par la demanderesse;<\/li><li>La d\u00e9cision provisoire \u00e9tait contraire \u00e0 la jurisprudence \u00e9tablie concernant l'obligation de l'employeur de ne pas faire preuve de discrimination envers un membre du personnel \u00e0 cause de son invalidit\u00e9;<\/li><li>La d\u00e9cision provisoire \u00e9tait contraire \u00e0 la jurisprudence \u00e9tablie concernant l'obligation du syndicat de s'adapter \u00e0 l'invalidit\u00e9 d'un membre du personnel; et<\/li><li>Le TDPO s'est m\u00e9pris sur certains des faits et des preuves pr\u00e9sent\u00e9s.<\/li><\/ol><\/li><\/ol><p>Le TDPO en a conclu les points suivants :<\/p><ol><li style=\"list-style-type: none;\"><ol><li>La mani\u00e8re dont la demanderesse a fait part de ses all\u00e9gations de harc\u00e8lement sexuel \u00e0 l'employeur n'a pas entra\u00een\u00e9 d'obligation d'enqu\u00eater sur ses plaintes car la demanderesse a refus\u00e9 d'identifier le pr\u00e9tendu harceleur, a refus\u00e9 de fournir des d\u00e9tails et\/ou a sp\u00e9cifiquement demand\u00e9 \u00e0 ce qu'on n'approfondisse pas la question. De plus, la demanderesse a avou\u00e9 avoir soulev\u00e9 ces all\u00e9gations afin de compenser pour un cong\u00e9 qu'elle n'avait pas r\u00e9ussi \u00e0 obtenir.<\/li><li>Les preuves d\u00e9montrent que lorsque l'employeur a \u00e9t\u00e9 inform\u00e9 des violations all\u00e9gu\u00e9es de sa politique antitabagisme, celui-ci les a prises au s\u00e9rieux et a pris des mesures suppl\u00e9mentaires pour faire appliquer la politique.<\/li><li class=\" translation-block\">Le syndicat n'a pas viol\u00e9 le Code lorsqu'il a \u00ab injustement \u00bb programm\u00e9 deux r\u00e9unions auxquelles la demanderesse ne pouvait pas assister. La constitution du syndicat ne donne pas droit \u00e0 une personne d'assister \u00e0 une r\u00e9union au cours de laquelle son affiliation est en jeu. De plus, la demanderesse n'a fourni aucun document prouvant que ses absences \u00e9taient li\u00e9es \u00e0 son invalidit\u00e9. Le TDPO n'a pas le pouvoir d'\u00e9valuer des plaintes g\u00e9n\u00e9rales d'injustice et la demanderesse n'a pas d\u00e9montr\u00e9 de lien entre cette injustice all\u00e9gu\u00e9e et le Code. En outre, le syndicat n'a pas \u00e9chou\u00e9 \u00e0 s'adapter \u00e0 l'invalidit\u00e9 de la demanderesse en proposant une \u00e9valuation professionnelle. En r\u00e9alit\u00e9, le syndicat s'est donn\u00e9 beaucoup de mal pour r\u00e9pondre aux besoins de la demanderesse.
