En rejetant la demande, le Tribunal a critiqu\u00e9 le comportement de la requ\u00e9rante et les positions juridique qu'elle avait prises comme \u00e9tant  ind\u00e9fendable, sp\u00e9cieuses ou fond\u00e9es sur un \u00abmalentendu conscient des faits\u00bb.<\/p><p>L'affaire avait \u00e9t\u00e9 devant le Tribunal pendant huit ans, entra\u00eenant 20 dates d'audience. La requ\u00e9rante avait pr\u00e9sent\u00e9 sa preuve au cours des 15 premiers jours d'audience, apr\u00e8s lesquelles le Tribunal a sollicit\u00e9 des arguments sur la question de savoir si la requ\u00eate devait \u00eatre rejet\u00e9e. Le Tribunal a rejet\u00e9 plusieurs des all\u00e9gations contre le syndicat, l'ancien employeur et les intim\u00e9s individuels dans une d\u00e9cision provisoire, permettant seulement la poursuite contre Marcone. Marcone avait travaill\u00e9 avec la requ\u00e9rante en tant que man\u0153uvre et machiniste pendant le Festival Shaw de 2007-2008. La demanderesse avait all\u00e9gu\u00e9 que Marcone l'avait harcel\u00e9e sexuellement par ses commentaires, des contacts physiques non d\u00e9sir\u00e9s, y compris des pincements, et des harc\u00e8lements en raison de son handicap en fumant pr\u00e8s d'elle, aggravant ainsi son asthme.<\/p><p>Le Tribunal a d\u00e9termin\u00e9 que le comportement de la requ\u00e9rante et ses positions bizarres mettaient en doute sa capacit\u00e9 de pr\u00e9senter l'information de mani\u00e8re fiable. Selon la requ\u00e9rante, le syndicat et l'entreprise qui la repr\u00e9sentait avaient acc\u00e8s \u00e0 un dossier policiers secret contre; le Tribunal a rejet\u00e9 cet argument. La demanderesse a \u00e9galement soutenu que le Tribunal avait modifi\u00e9 les documents dans son dossier et retir\u00e9 des pages. La requ\u00e9rante avait \u00e9galement demand\u00e9 plusieurs prorogations de d\u00e9lai pour d\u00e9poser une r\u00e9ponse en raison du fait que l'intim\u00e9 n'aurait pas retourn\u00e9 un lecteur zip, et que l'avocat de l'intim\u00e9 a fait des blagues inappropri\u00e9es. Le Tribunal a refus\u00e9 d'accorder la prolongation au-del\u00e0 de trois mois.\u00a0<\/p><p>En rejetant la demande, le Tribunal a not\u00e9 qu'il existait des doutes quant \u00e0 la cr\u00e9dibilit\u00e9 de la preuve de l'intim\u00e9, et la d\u00e9cision n'exon\u00e8re pas Marcone.
