Arts Guild Inc. (l'\"employeur\") au 115, rue Richmond, \u00e0 Charlottetown. Bien qu'elle ait d'abord soutenu qu'elle n'avait pas de travailleurs de sc\u00e8ne \u00e0 son emploi \u00e0 la date de la demande, le 2 f\u00e9vrier 2023, la Guild a avis\u00e9 la Commission qu'elle ne contesterait pas la demande.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p class=\" translation-block\">La section locale 906 a r\u00e9ussi \u00e0 obtenir l'accr\u00e9ditation. Toutefois, avant d'\u00eatre accr\u00e9dit\u00e9e, conform\u00e9ment aux paragraphes 13(1) et (3) de la Loi sur le travail (la \"Loi\"), la Commission a examin\u00e9 deux questions : i) si la description de l'unit\u00e9 de n\u00e9gociation \u00e9tait appropri\u00e9e pour la n\u00e9gociation collective et ii) si la majorit\u00e9 des employ\u00e9s vis\u00e9s par la description de l'unit\u00e9 de n\u00e9gociation d\u00e9siraient \u00eatre repr\u00e9sent\u00e9s par la section locale 906.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>En ce qui concerne la premi\u00e8re question, la Commission a convenu que la description de l'unit\u00e9 de n\u00e9gociation \u00e9tait appropri\u00e9e. Pour ce qui est de la deuxi\u00e8me question, la Commission a estim\u00e9 que les \u00e9l\u00e9ments de preuve n'\u00e9taient pas clairs quant aux employ\u00e9s qui devaient \u00eatre inclus dans l'unit\u00e9 de n\u00e9gociation. La Commission a entrepris une analyse pour trois employ\u00e9s nomm\u00e9s Donald Richard, Nathaniel Ing et Tanguy Merrien.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>La Commission a conclu que M. Richard devait \u00eatre inclus dans l'unit\u00e9 de n\u00e9gociation m\u00eame s'il n'avait pas travaill\u00e9 pour l'employeur \u00e0 la date de la demande, parce qu'il avait \u00e9t\u00e9 embauch\u00e9 \u00e0 cette date et qu'il avait donc \"un int\u00e9r\u00eat suffisant dans la pr\u00e9sente demande et son issue\".<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Il y avait un conflit factuel concernant M. Merrien et M. Ing, qui, selon le syndicat, avaient tous deux d\u00e9missionn\u00e9 avant la date de d\u00e9p\u00f4t de la demande, l'un ayant d\u00e9m\u00e9nag\u00e9 au Qu\u00e9bec et l'autre ayant commenc\u00e9 \u00e0 travailler \u00e0 l'universit\u00e9. La Commission a estim\u00e9 qu'ils n'\u00e9taient pas facilement disponibles pour travailler en raison de contraintes g\u00e9ographiques ou d'autres obligations et qu'ils n'avaient donc pas de lien suffisant avec le lieu de travail pour \u00eatre consid\u00e9r\u00e9s comme employ\u00e9s.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Enfin, la Commission a examin\u00e9 une autre question soulev\u00e9e par l'employeur dans ses observations \u00e9crites, \u00e0 savoir si les travailleurs en question \u00e9taient effectivement des employ\u00e9s au sens de la Loi ou des \"occasionnels\" ou des \"entrepreneurs\", compte tenu des heures de travail peu fr\u00e9quentes et de l'absence all\u00e9gu\u00e9e d'obligation d'effectuer des quarts de travail. Pour parvenir \u00e0 ses conclusions, la Commission a not\u00e9 et approuv\u00e9 la jurisprudence selon laquelle le r\u00e9gime de n\u00e9gociation collective pr\u00e9vu par la loi s'applique aux \"occasionnels\" et que \"les employ\u00e9s occasionnels, \u00e0 court terme, temporaires et stagiaires doivent \u00eatre inclus dans la m\u00eame unit\u00e9 que les employ\u00e9s permanents\". La Commission a not\u00e9 que, bien que le travail \u00e0 temps plein ou \u00e0 temps partiel puisse \u00eatre pris en compte pour d\u00e9terminer si l'unit\u00e9 de n\u00e9gociation est appropri\u00e9e, il n'affecte pas le statut d'employ\u00e9 d'un travailleur.
