Le Syndicat a refus\u00e9 d\u2019acquiescer \u00e0 la demande du requ\u00e9rant et le requ\u00e9rant a fait valoir dans la demande que les motifs du Syndicat pour refuser sa demande contrevenaient \u00e0 l\u2019article 75 de la Loi parce certains individus le service des transports qui n\u2019avaient pas les qualifications que le Syndicat avait dit au requ\u00e9rant qu'il avait besoin afin d'\u00eatre transf\u00e9r\u00e9.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Dans sa d\u00e9cision, la Commission \u00e9tait d'accord avec le Syndicat que le requ\u00e9rant ne satisfaisait pas aux exigences de la convention collective pour \u00eatre inclus dans le service du transport et ne tombait pas dans l'une des trois exceptions puisqu'il n'\u00e9tait pas un ancien membre, ne souffrait pas d'un handicap n\u00e9cessitant des am\u00e9nagements et n'\u00e9tait pas membre d'un syndicat rival. Toutefois, la Commission a conclu qu'elle ne pouvait conclure que la d\u00e9cision du Syndicat de ne pas permettre au requ\u00e9rant de se joindre au service des transports \u00e9tait raisonnable puisqu'il y avait entre deux et quatre membres qui ne remplissaient pas l'exigence et ne relevaient pas de l'une des trois exceptions.
