Local 800 v. Canadian Opera Co. [2002] O.L.R.D. No. 3935 (Ontario Labour Relations Board)

Application for certification (second of three decisions). There was a dispute as to whether the bargaining unit description should exclude the department assistant and whether the bargaining unit description should be described as “all wig and make-up employees of the Responding Party involved in the running of shows…”  The Board issued an interim certificate for “all wig and make-up employees of the Responding Party in the City of Toronto, save and except wig and make-up supervisor and persons above the rank of wig and make-up supervisor.”  On the taking of a representation vote, more than fifty percent of the ballots cast by employees in the bargaining unit were cast in favour of the local, regardless of the outcome of the dispute over the bargaining unit.
