Local 822 v. Opera Atelier [2002] O.L.R.D. No. 1417 (Ontario Labour Relations Board)

Application for certification.  The local had been previously found to be a trade union within the meaning of the Act.  The Opera took the position that the bargaining unit should be restricted to its wardrobe employees employed “in the production of professional theatre performed at the Elgin Theatre in the City of Toronto.”  The Board directed that a representation vote be taken of “all Wardrobe employees employed by the Responding Party in the City of Toronto, save and except Production Manager and persons above that rank.”  The Board directed that the ballots be segregated and not counted until the Board so ordered or the parties agreed.
