Local 828 v. Theatre Aquarius Inc. [2003] O.L.R.D. No. 3792 (Ontario Labour Relations Board)

Application for certification (second of two decisions).  Of six ballots counted in a representation vote, three were cast in favour of the local, three against.  There remained five ballots which were cast and challenged by the Theatre and not counted.  On the counting of the ballots not more than fifty percent of the ballots were cast in favour of the local.  The Board dismissed the application.
