Application for certification (first of two decisions). The local had not previously established trade union status within the meaning of the Act. The Theatre disputed the local’s estimate of the number of employees in the proposed bargaining unit and proposed a different bargaining unit contenting that the local’s proposed bargaining unit could not be appropriate. In particular, the Theatre sought to exclude supervisors and persons above the rank of supervisor, whereas the local’s proposal had excluded the production manager and persons above that rank. The Board found that the numerical different between the parties was not significant and deferred to a later date the issue of the appropriateness of the bargaining unit. The Board directed that a representation vote be taken of “all employees of the Grand Theatre, engaged in painting theatrical scenery and the building of theatrical props in the City of London, save and except supervisors and persons above the rank of supervisor. The Board further directed that any disputed ballots be segregated and not counted until the Board so ordered or the parties agreed.
