Local 118 v. Theatre Under the Stars Musical Society [2004] B.C.L.R.B.D. No. 105 (BC Labour Relations Board)

Application for certification of site stage crew/technical employees at and from Malkin Bowl, Stanley Park and 2099 Beach Avenue, Vancouver BC. The employer objected on the bases that the individuals applied for were independent contractors, not employees, that TUTS was not the true employer, that the bargaining unit was not appropriate and that the technical director should be considered an excluded manager.  The Board found that individuals in the proposed unit were employees, not independent contractors; TUTS was the true employer and the proposed bargaining unit, with the exception of the Technical director who the Board excluded for being a manager.
