IATSE Local 63 v. Keystone Entertainment Group Ltd. [2009] M.L.B. No. 278/09/LRA (Manitoba Labour Board)

Following the local’s application for certification, Keystone filed a letter of response, not supported by Statutory Declaration, in which it indicated that it had never had stagehands in its employ, and making reference to certain contractor companies.  The Board informed the parties that Keystone’s letter of response did not constitute a proper Relay in accordance with the Rules of Procedure.  In the absence of a proper Return combined with Keystone’s failure to provide additional information as directed by the Board, the Board found that Keystone did not dispute that it was the Employer and granted the local a certificate for “all Stagehands employed by the Employer in the Province of Manitoba, excluding Stage Manager, members of the road crew travelling regularly with the production, and employees excluded by The Labour Relations Act.
