All employees of the Respondent employed as stage technicians in the supply erection, set up, maintenance, operation and dismantling of stage and production equipment, and related services for the presentation of concerts, stage productions, meetings and/or other theatrical, musical or community events except for technical director, supervisors and those above the rank of supervisor and those excluded by section 2(b) of the Labour Act.

Employees of the Responding Party filed correspondence with the Board on January 29, 2012 attempting to intervene in the Application.  The Board declined to consider the employees’ correspondence as it was filed outside the timelines set out in the Labour Act’s regulations and was therefore determined to be untimely.

The Board found that Applicant had applied for an appropriate bargaining unit and therefore certified the Applicant as the bargaining agent for the above-noted bargaining unit.
