Local 891 and DGC British Columbia v. Grey Fox [1981] B.C.L.R.B.D. No. 66 (BC Labour Relations Board)

Applications for certification brought by Local 891 and DGC British Columbia.  The competing applications overlapped with respect to the Art department.  The Board dismissed the DGC’s applications after finding that it was not a trade union within the meaning of the Act; i.e., it was not local or provincial in character as required by the Labour Code.  By contrast, the Board granted local 891’s applications after finding that the proposed units were appropriate (if not most appropriate) for bargaining.  Despite its findings, the Board urged local 891 to reconsider its decision to consider the DGC a rival union and to expel individuals for holding dual membership.
